AMSTERDAM, 15 JULY 2026<\/span> \u2013 <\/span><\/b>Malak, who was in her final weeks of pregnancy when she was assaulted by multiple police officers in an asylum seekers centre (<\/span>azc<\/span><\/i>) in the Netherlands, has filed a criminal complaint against the police officers involved. The complaint addresses attempted grievous bodily harm, assault, and breach of the use-of-force guidelines. This follows the <\/span>publication<\/span><\/a> of an investigation by a <\/span>police integrity committee<\/span>, which concluded that the violence had been \u2018necessary\u2019. <\/span>Footage<\/span><\/a> shows how a police officer violently threw Malak onto the floor, <\/span>after which several police officers brutally dragged her along. After the incident, Malak went into early labour.<\/span>\u00a0<\/span><\/p>\n

Malak is being supported by the European Legal Support Center (ELSC) and lawyer Willem Jebbink.<\/span>\u00a0<\/span><\/p>\n

State-sponsored violence<\/span><\/b>\u00a0<\/span><\/h2>\n

According to the ELSC, the case demonstrates how the full force of state-sponsored violence can be inflicted on asylum seekers by the Dutch state. Malak and her husband fled atrocities and war crimes in their homes in Syria and Gaza respectively, to seek safety in the Netherlands, only to confront a system of structural violence against migrants, enacted by the very state that has been complicit in the destruction of their homes. Their experience is not unfamiliar to many other asylum seekers or migrants who have little to no access to support systems as they encounter a state deploying multiple arms of power against them.<\/span>\u00a0<\/span>\u00a0<\/span><\/p>\n

What went viral was the video that documented the assault on Malak on 19 May 2026. According to the ELSC, what was not visible in the video is what systems Malak had to confront before and after. What is not visible is what it means for a woman traumatised by wars and displacement to have to confront a crushing bureaucracy in a language she does not speak and a system designed to disregard her dignity and humanity. It is not visible how she was made to give birth alone with an early induction after being beaten by the police and suffering a head trauma without due care.<\/span>\u00a0<\/span><\/p>\n

What Malak\u2019s experience demonstrates, together with many other asylum seekers and migrants as also researched by many <\/span>institutions<\/span><\/a>, is that systems of support that the states trumpet are not always accessible due to language, social and other barriers in a system that offers no empathy to a pregnant woman left to navigate her life in a new country, alone.<\/span>\u00a0<\/span><\/p>\n

Accountability for the Dutch police that investigated and absolved itself<\/span><\/b>\u00a0<\/span><\/h2>\n

The Dutch police officers that were present in the asylum seekers centre in Zeist approached Malak, exclusively communicating in Dutch. The officers responded to a call regarding a potato peeler, which according to the testimonies the ELSC has received, they were aware was not in the possession of Malak nor her husband.<\/span>\u00a0<\/span><\/p>\n

The fact that the Dutch police investigated itself and concluded that the violence was necessary and did not publish the contents of the investigation is absurd. The ELSC, together with lawyer Willem Jebbink, will continue to pursue the case until an independent judge reviews it using all video material available that the police already have in their possession.<\/span>\u00a0<\/span><\/p>\n

Willem Jebbink, lawyer at Jebbink Soeteman Advocaten, says<\/span><\/b>:<\/span> \u201c<\/span>My client was admitted to the hospital on the same day and remained there for four days. She was extremely concerned about the welfare of her unborn child and continues to suffer from psychological trauma to this day. The findings of the internal investigation, which have only been disclosed in broad terms, leave many questions unanswered. It is desirable that the court rules on whether a criminal threshold has been crossed in this case.<\/span><\/i>\u201d<\/span>\u00a0<\/span><\/p>\n

Daan de Grefte, Senior Legal Officer at the ELSC, added<\/span><\/b>: \u201c<\/span>Too often, stomach-turning acts of violence against the most vulnerable among us \u2013 in this case a pregnant woman who fled devastation in her country to look for safety \u2013 are whitewashed by internal police investigations. This is one of the few cases that see the light of day because it was filmed by bystanders. This fight is about accountability for institutional racism and violence inflicted on asylum seekers in general, and Palestinians in particular.<\/span><\/i>\u201d<\/span>\u00a0<\/span><\/p>\n

Zwangere vrouw aangevallen door Nederlandse politie in asielzoekerscentrum doet aangifte<\/span><\/b>\u00a0<\/span><\/h1>\n

MSTERDAM, 15 JULI 2026 <\/span>\u2013 <\/span><\/b>Malak, de vrouw die in haar laatste weken van haar zwangerschap was toen ze door meerdere politieagenten werd aangevallen in een asielzoekerscentrum (azc) in Zeist, heeft aangifte gedaan tegen de betrokken politieagenten. De aangifte betreft poging tot zware mishandeling, mishandeling en schending van de geweldsinstructie. Dit volgt op de <\/span>publicatie<\/span><\/a> van een onderzoek door een i<\/span>ntegriteitscommissie van de politie<\/span>, waarin werd geconcludeerd dat het geweld \u2018noodzakelijk\u2019 was. <\/span>Beelden<\/span><\/a> tonen hoe een politieagent Malak met geweld op de grond gooit, <\/span>waarna meerdere politieagenten haar op brute wijze voortslepen. Na het incident kreeg Malak vroegtijdige wee\u00ebn.<\/span>\u00a0<\/span><\/p>\n

Malak wordt bijgestaan door het European Legal Support Center (ELSC) en advocaat Willem Jebbink.<\/span>\u00a0<\/span><\/p>\n

Staatsgeweld<\/span><\/b>\u00a0<\/span><\/h2>\n

Volgens het ELSC laat de zaak zien hoe de Nederlandse staat asielzoekers met al zijn macht kan treffen. Malak en haar man zijn gevlucht voor wreedheden en oorlogsmisdaden van hun thuis in respectievelijk Syri\u00eb en Gaza om veiligheid te zoeken in Nederland maar werden daar geconfronteerd met een systeem van structureel geweld tegen migranten, uitgevoerd door juist die staat die medeplichtig is geweest aan de vernietiging van hun thuis. Hun ervaring is niet onbekend voor veel andere asielzoekers of migranten die weinig tot geen toegang hebben tot ondersteuning terwijl ze te maken krijgen met een staat die zijn machtsmiddelen tegen hen inzet.<\/span>\u00a0<\/span><\/p>\n

Wat viraal ging, was de video waarin de aanval op Malak op 19 mei 2026 werd vastgelegd. Volgens het ELSC is wat niet zichtbaar was in de video de onderdrukking waarmee Malak voor en na de aanval te maken kreeg. Wat niet zichtbaar is, is wat het betekent voor een vrouw die getraumatiseerd is door oorlogen en ontheemding om geconfronteerd te worden met een bureaucratie in een taal die ze niet spreekt en een systeem dat erop is gericht haar waardigheid en menselijkheid te negeren. Het is niet zichtbaar hoe ze gedwongen werd om alleen vroegtijdig te bevallen, nadat ze door de politie was geslagen en een hoofdtrauma had opgelopen zonder dat de nodige zorg werd geboden.<\/span>\u00a0<\/span><\/p>\n

Wat Malaks ervaring aantoont, samen met die van vele andere asielzoekers en migranten \u2013 zoals ook door veel <\/span>instellingen<\/span><\/a> is onderzocht \u2013 is dat de structuren waarmee de staten zo hoog van de toren blazen, niet altijd toegankelijk zijn vanwege taal-, sociale en andere barri\u00e8res in een systeem dat geen empathie toont voor een zwangere vrouw die er alleen voor staat om haar weg te vinden in een nieuw land.<\/span>\u00a0<\/span><\/p>\n

Verantwoording voor de Nederlandse politie die onderzoek deed en zichzelf vrijsprak<\/span><\/b>\u00a0<\/span><\/h2>\n

De Nederlandse politieagenten die aanwezig waren in het azc in Zeist benaderden en communiceerden met Malak uitsluitend in het Nederlands. De agenten reageerden op een melding over een aardappelschiller, waarvan zij volgens de getuigenissen die het ELSC heeft ontvangen, wisten dat deze niet in het bezit was van Malak noch van haar echtgenoot.<\/span>\u00a0<\/span><\/p>\n

Het feit dat de Nederlandse politie een eigen onderzoek heeft ingesteld en tot de conclusie is gekomen dat het geweld noodzakelijk was, en de inhoud van het onderzoek niet openbaar heeft gemaakt, is absurd. Het ELSC zal, samen met advocaat Willem Jebbink, de zaak blijven doorzetten totdat een onafhankelijke rechter deze beoordeelt aan de hand van alle beschikbare beelden die de politie al in diens bezit heeft.<\/span>\u00a0<\/span><\/p>\n

Willem Jebbink, advocaat bij Jebbink Soeteman Advocaten, zegt<\/span><\/b>: <\/span>\u201eMijn cli\u00ebnte werd nog dezelfde dag in het ziekenhuis opgenomen en verbleef daar vier dagen. Ze maakte zich enorme zorgen over het welzijn van haar ongeboren kind en lijdt tot op de dag van vandaag aan een psychologisch trauma. De bevindingen van het interne onderzoek, die slechts in algemene termen zijn bekendgemaakt, laten veel vragen onbeantwoord. Het is wenselijk dat de rechter uitspraak doet over de vraag of in deze zaak de strafrechtelijke drempel is overschreden<\/span><\/i>.\u201d<\/span>\u00a0<\/span>\u00a0<\/span><\/p>\n

Daan de Grefte, jurist bij het ELSC, voegt hieraan toe<\/span><\/b>: <\/span>\u201cMaar al te vaak worden weerzinwekkende gewelddaden tegen de meest kwetsbaren onder ons \u2013 in dit geval een zwangere vrouw die de verwoesting in haar land ontvluchtte op zoek naar veiligheid \u2013 door interne politieonderzoeken in de doofpot gestopt. Dit is een van de weinige gevallen die het daglicht zien, omdat het door omstanders werd gefilmd.
