In a new legal case, the European Legal Support\u00a0Center\u00a0(ELSC)\u00a0<\/s>\u00a0is defending\u00a0an antifascist\u00a0activist\u2019s\u00a0right to commemorate at\u00a0Holocaust memorial site Buchenwald, after\u00a0she was\u00a0banned and threatened with a criminal complaint\u00a0by the memorial\u2019s administration\u00a0for wearing a\u00a0Kufiya.\u00a0This case challenges the criminalisation of Palestinian symbols and the role of memorial and cultural institutions in the repression of Palestine solidarity.<\/em>\u00a0

ELSC Partner lawyer Roland Meister\u00a0has\u00a0filed a complaint at the\u00a0Weimar Administrative Court (Verwaltungsgericht\u00a0Weimar),\u00a0against\u00a0the Buchenwald and\u00a0Mittelbau-Dora Memorials Foundation on behalf of antifascist activist\u00a0Anna M.\u00a0The complaint challenges a ban imposed on Anna M. from entering the memorial site, which violates\u00a0fundamental democratic rights and freedoms guaranteed by the German Constitution, the European Convention on Human Rights (ECHR),<\/s>\u00a0and the Charter of Fundamental Rights of the European Union (CFREU).\u00a0<\/p>\r\n\r\n\r\n\r\n

Background:<\/s><\/strong>\u00a0<\/h2>\r\n\r\n\r\n\r\n

The case originates from\u00a06\u00a0April 2025\u00a0when\u00a0Anna M. entered\u00a0the Buchenwald\u00a0memorial site\u00a0to\u00a0participate\u00a0in the annual commemoration\u00a0ceremony marking the liberation of the former Nazi concentration camp.\u00a0She was\u00a0immediately\u00a0approached by\u00a0foundation\u00a0staff and pressured to remove her\u00a0Kufiya,\u00a0\u00a0which they claimed violated the foundation\u2019s house rules.\u00a0When Anna M. refused to\u00a0remove the scarf, staff banned her from the\u00a0premises\u00a0and threatened to file a criminal complaint for unlawful entry\u00a0under\u00a0section 123 of the German criminal code\u00a0The discrimination took place at a site dedicated to remembering victims of fascist terror, yet was enforced\u00a0against an antifascist commemorating that very history.\u00a0

In July 2025 Anna M.\u00a0informed the\u00a0foundation\u00a0of her\u00a0intention to\u00a0visit\u00a0Buchenwald\u00a0on 18\u00a0August 2025 to\u00a0commemorate the murders of the\u00a0communist Buchenwald concentration camp inmate Rudi Opitz and\u00a0the\u00a0German communist party\u00a0leader\u00a0Ernst\u00a0Th\u00e4lmann\u00a0<\/s>, who were killed by the Nazi regime in\u00a0August\u00a01939 and\u00a01944\u00a0respectively.\u00a0As an opponent of\u00a0Germany\u2019s complicity in the ongoing genocide in Gaza,\u00a0Anna M. insisted on wearing the\u00a0Kufiya\u00a0as a symbol of solidarity with liberation movements and the fight against racism,\u00a0fascism\u00a0and\u00a0oppression,\u00a0as well\u00a0as an expression of the\u00a0Palestinian\u00a0people’s culture and\u00a0struggle.\u00a0The Buchenwald memorial foundation responded by reiterating their ban of\u00a0Kufiya\u00a0scarfs and\u00a0confirmed\u00a0that Anna\u00a0M.\u00a0would be denied access to the memorial\u00a0premises.\u00a0Thereby\u00a0formalising\u00a0the ban.\u00a0\u00a0

To challenge this decision,\u00a0Anna M. filed\u00a0an urgent appeal to the\u00a0Weimar Administrative Court (Verwaltungsgericht\u00a0Weimar),\u00a0through\u00a0ELSC Partner lawyer Roland Meister,\u00a0seeking an\u00a0interimmeasure\u00a0to lift the ban.\u00a0The foundation\u00a0stretched\u00a0logic\u00a0before the court\u00a0arguing\u00a0that\u00a0the\u00a0Kufiya\u00a0\u00a0has been\u00a0\u201cassociated with anti-Jewish and anti-Western positions since the time of the National Socialist dictatorship\u201d,\u00a0\u00a0\u201ca symbol associated with the annihilation of Israel\u201d,\u00a0its presence\u00a0would\u00a0compromise the\u00a0\u201cdignity of the victims\u201d\u00a0commemorated at the site, and\u00a0might\u00a0provoke other visitors.\u00a0\u00a0The foundation\u00a0continued\u00a0with the stretched logic claiming\u00a0that\u00a0wearing the\u00a0Palestinian symbol at the memorial site would\u00a0constitute\u00a0\u201cinstrumentalisation\u00a0of commemoration for political purposes\u201d and \u201ca deliberate political statement against Israel\u201d.\u00a0The foundation explicitly argued that wearing the Israeli flag in contrast \u201cdoes not constitute a political statement, but rather documents, at most, a personal attachment to a state whose existence is not up for debate.\u201d\u00a0

On\u00a014.<\/s>\u00a0August the Weimar Administrative Court rejected\u00a0the\u00a0urgent appeal.\u00a0The Thuringian Higher Administrative Court (Th\u00fcringer\u00a0Oberverwaltungsgericht)\u00a0later upheld\u00a0this decision \u2013 prompting the current legal action\u00a0with the support of the ELSC\u00a0for a\u00a0subsequent\u00a0declaration\u00a0of\u00a0unlawfulness (Fortsetzungsfestellungsklage).\u00a0<\/p>\r\n\r\n\r\n\r\n

Anna M.\u00a0described the broader implications of the case,\u00a0stating:\u00a0\u00a0

\u201cI have been going to Buchenwald for many years to commemorate the history and resistance of those imprisoned there by German fascists. Their oath not\u00a0to\u00a0rest until the last\u00a0guilty\u00a0arebrought to international justice, to fight Nazism and its roots, to stand up for freedom and peace worldwide is my guiding principle. I refuse to accept that the\u00a0genocide in Palestine is now denied in this very place \u2013\u00a0that\u2019s\u00a0why I am taking legal action. But my case is just one of many cases of anti-Palestinian repression by this foundation. Their silencing of\u00a0Palestine solidarity must stop, openly addressing the\u00a0genocide in Gaza must be allowed.\u201d\u00a0<\/p>\r\n<\/blockquote>\r\n\r\n\r\n\r\n

The institutionalised\u00a0Anti-Palestinian Repression\u00a0at Buchenwald\u00a0and\u00a0Beyond<\/strong>\u00a0<\/h2>\r\n\r\n\r\n\r\n

\u201cTo speak about Genocide is not appropriate at a place like this\u201d –\u00a0The Buchenwald memorial foundation\u2019s well documented anti-Palestinian repression\u00a0<\/strong>\u00a0<\/p>\r\n\r\n\r\n\r\n

The ban on Palestinian symbols at Buchenwald is not an\u00a0isolated\u00a0measure, but part of a systematic policy of repression.\u00a0Anna\u00a0M\u2019s\u00a0case only revealed how far they could go to make it visible.\u00a0
In July 2025,\u00a0the foundation published a handout\u00a0that classified\u00a0Palestinian\u00a0symbols of\u00a0Palestinian including\u00a0the\u00a0Kufiya\u00a0\u00a0as\u00a0\u00a0\u201chostile to Israel\u201d and therefore\u00a0as antisemitic.\u00a0The document\u00a0mentioned\u00a0the watermelon as\u00a0“a substitute for the Palestinian flag\u201d and\u00a0went as far as to\u00a0describe the phrase \u201cceasefire\u00a0now\u201d as\u00a0\u201cone-sided demand at Israel’s expense\u201d.\u00a0It\u00a0warned\u00a0that even\u00a0an\u00a0olive branch\u00a0symbol\u00a0could express the connection of Palestinians to their land and can therefore be considered as \u201ca denial of the right of Jewish people to live in Israel\u201d.\u00a0

Furthermore, the foundation\u00a0declared\u00a0that accusing\u00a0Israel of the well-documented crimes against humanity,\u00a0Apartheid\u00a0and\u00a0genocide against the Palestinian people would be \u201cdemonising Israel\u201d.\u00a0
The Buchenwald memorial foundation\u2019s\u00a0willingness\u00a0to silence\u00a0Palestine solidarity\u00a0became\u00a0apparent\u00a0to a larger German and international public when\u00a0Buchenwald disinvited\u00a0Israeli-German\u00a0philosopher Omri Boehm\u00a0from\u00a0the annual commemoration\u00a0event\u00a0on\u00a0April 2025.\u00a0

This came after\u00a0the intervention of the\u00a0Israeli Embassy to Germany against\u00a0Boehm\u2019s presence at the\u00a0commemoration ceremony, claiming that\u00a0Boehm\u00a0\u201cattempts to\u00a0undermine\u00a0the memory of the Holocaust\u00a0under the guise of science\u00a0with\u00a0his\u00a0talk of\u00a0universal values\u201d.\u00a0\u00a0The memorial foundation quickly\u00a0published a\u00a0statement\u00a0acknowledging\u00a0Boehm an \u201cinternationally recognised\u00a0German-Israeli\u00a0philosopher and grandson of a Holocaust survivor\u201d but\u00a0nonetheless\u00a0confirmed\u00a0they\u00a0were giving\u00a0in to the Israeli\u00a0embassy\u2019s\u00a0<\/s>political pressure to disinvite\u00a0him.\u00a0

When a Spanish student\u00a0participant in the youth project organised by the International Committee Buchenwald-Dora urged to oppose the Genocide in Gaza\u00a0in her speech\u00a0at the\u00a0same\u00a0Buchenwald commemoration ceremony<\/a>,\u00a0the director of the memorial foundation Jens-Christian Wagner\u00a0intervened and stated \u201cI consider\u00a0speaking\u00a0about a Genocide, like we just heard,\u00a0as not appropriate at a place like this\u201d. In a\u00a0subsequent interview<\/a>\u00a0he\u00a0declared\u00a0the\u00a0student’s\u00a0opposition to the\u00a0genocide\u00a0in Gaza\u00a0as\u00a0an \u201cantisemitic attack\u201d.\u00a0

Buchenwald is\u00a0not an\u00a0exception\u00a0among German Genocide memorial foundations.\u00a0In June 2024,\u00a0the\u00a0directors of the\u00a0NS\u00a0memorial sites\u00a0in Berlin\u00a0dismissed\u00a0-in\u00a0a joint statement<\/a>\u00a0–\u00a0the\u00a0students\u00a0demand\u00a0for\u00a0the universities to\u00a0officially\u00a0recognise\u00a0the\u00a0Israeli\u00a0Genocide in\u00a0describing\u00a0it\u00a0as an\u00a0\u201canti-Israel ideology that refuses to critically assess the present\u201d<\/s>.\u00a0\u00a0

Internationally renowned institutions like the Lemkin Institute for Genocide Prevention have since\u00a0condemned<\/a>\u00a0\u201cthe persistent efforts by several high-profile German civil society organisations to deny the ongoing genocide in Gaza and to\u00a0disseminate\u00a0disinformation and denialist narratives among German political decision-makers.\u201d\u00a0<\/p>\r\n\r\n\r\n\r\n

Kufiyas\u00a0in Buchenwald \u2013 Anti-Genocidal campaign sparks outrage and condemnation by German Government<\/strong>\u00a0<\/h2>\r\n\r\n\r\n\r\n

To address the Genocide denial and anti-Palestinian repression committed by the Buchenwald memorial foundation, a coalit<\/span>i<\/span>on<\/span> of groups and individuals in solidarity with Palestine including plaintiff Anna M. have launched the \u201cKufiyas in Buchenwald\u201d campaign with an open letter. The coalition demands \u201cto openly address the genocide in Gaza at the Buchenwald Memorial, no bans on Palestinian symbols at the Buchenwald Memorial and no denigration of them as anti<\/span>–<\/span>semitic, no entry- or speaking bans on the premises due to solidarity with Palestine or criticism of the apartheid state of Israel\u201d. The open letter was signed by a variety of German and international organisations and individuals – including the ELSC. The call remains open for signings.<\/span>\u00a0<\/span><\/p>\r\n

In addition,\u00a0the\u00a0coalition\u00a0is planning\u00a0series of public events and protests\u00a0around\u00a0Buchenwald and\u00a0across\u00a0German cities in 2026, including a\u00a0conference\u00a0on 11 and\u00a012\u00a0\u00a0April.\u00a0\u00a0<\/s>Their\u00a0initiative has been met with memorial foundation Buchenwald\u2019s<\/a>\u00a0disregard,\u00a0refusals\u00a0to acknowledge\u00a0the\u00a0demands\u00a0and unwillingness to engage in any form of public discussion\u00a0of\u00a0its\u00a0anti-Palestinian repression.\u00a0

By\u00a0condemning and slandering the campaign, the foundation is\u00a0joining\u00a0German government officials, media outlets\u00a0and\u00a0other\u00a0proponents\u00a0of\u00a0<\/s>\u00a0anti-Palestinian repression\u00a0and\u00a0genocide denial.\u00a0The notoriously anti-Palestinian tabloid BILD\u00a0published pictures and names of the initiators of the campaign in\u00a0an\u00a0article titled \u201cThese are Buchenwald’s Israel haters\u201d,\u00a0in which the Federal German Government official antisemitism commissioner Felix Klein and the Israeli ambassador to Germany Ron Prosor\u00a0incite\u00a0against the campaign.\u00a0

The right-wing\u00a0and racist tabloid is known for publishing denunciatory slander aiming to intimidate\u00a0anti-genocide\u00a0voices in Germany.\u00a0For example: In\u00a0May 2024\u00a0they slandered<\/a>\u00a0the\u00a0German\u00a0history Professor Michael Wildt, who counts as on the leading experts on the Nazi Regime, as a \u201cJew-hater\u201d.\u00a0

The\u00a0recent\u00a0slanderous\u00a0article quotes the Federal German Government\u00a0Antisemitism\u00a0Commissioner Felix Klein and Israeli\u00a0ambassador to Germany Ron Prosor condemning the\u00a0campaign.According to the article, the\u00a0President of the\u00a0association\u00a0\u201cDeutsch-Israelische\u00a0Gesellschaft\u00a0e.V.\u201d\u00a0Volker Beck\u00a0has filed a criminal complaint for incitement to hatred (section 130 of the German criminal code) against the\u00a0campaigners.\u00a0<\/p>\r\n\r\n\r\n\r\n
