In June 2024 Berlin Appellate Court ruled that the freezing and cancellation of the association J\u00fcdische Stimme f\u00fcr gerechten Frieden in Nahost \u2013 EJJP Deutschland e. V. \/ Jewish Voice for Just Peace in the Middle East \u2013 EJJP Deutschland e. V.<\/a>‘s bank account by the partly state-owned bank Berliner Sparkasse was illegal. J\u00fcdische Stimme is a non-profit, independent Jewish association acting as the German branch of the umbrella organisation “European Jews for a Just Peace” (EJJP). <\/p>\n\n\n\n

Ahmed Abed, the lawyer representing J\u00fcdische Stimme stated: <\/p>\n\n\n\n

\n

“In a gross violation of the terms of agreement and general civil law, the bank had frozen the association’s account on short-notice and cancelled their contract in March 2024. The bank argued that the business relationship with J\u00fcdische Stimme could harm its reputation and a cancellation was necessary due to money laundering and terror-financing laws, to which the court found no basis whatsoever.” <\/p>\n<\/blockquote>\n\n\n\n

The decision of the bank to move against the human rights activist group needs to be understood in the context of the unprecedented authoritarian crack-down against the Pal\u00e4stina Kongress<\/a> in Berlin. Pal\u00e4stina Kongress was planned as an assembly of Palestinian, Jewish, German and international voices calling for an end of Israel\u2019s genocide in Gaza and denouncing Germany’s complicity. It was ultimately prevented from taking place in an illegal attack by German authorities with heavy police presence. J\u00fcdische Stimme had previously administered donations for the Pal\u00e4stina Kongress via their bank account. In a statement following the bank\u2019s cancellation of its account, J\u00fcdische Stimme hinted at pressure by the German police<\/a> that had repeatedly harassed the group, after the bank demanded a complete list of all the group\u2019s members. <\/em><\/p>\n\n\n\n

Moreover, German security agencies evidently used a range of extralegal measures to repress and shut down the congress. Their shameful actions include intimidating venues to pressure them not to host the event, preventing speakers from attending, including through issuing travel bans such as in the case of Ghassan Abu-Sittah<\/a>, and not least the raid that ultimately stopped the congress.<\/a> <\/p>\n\n\n\n

German authorities are clearly acting outside of the law and are actively encouraged by increasingly authoritarian politicians. For instance, Germany’s minister of interior Nancy Faeser (SPD) had openly pressured<\/a> the Berlin police to ”crack down hard” on the Kongress, and Berlin’s mayor Kai Wegener (CDU) declared<\/a>: ”It is intolerable that a so-called Palestine Congress will take place in Berlin”. <\/p>\n\n\n\n

Corporate complicity<\/strong> <\/h2>\n\n\n\n

German officials don’t necessarily need to resort to openly announcing illegal orders, they can often rely on corporate complicity. This is not the first time an unhinged misinformation campaign by German media and German authorities led to a cancellation of J\u00fcdische Stimme’s bank account.<\/a> <\/p>\n\n\n\n

This is part of a broader phenomenon known as derisking<\/em>, where financial institutions limit or terminate business relationships to avoid perceived risks. This practice has notably increased<\/a> in cases involving Palestinians and Palestinian organisations, reflecting a wider pattern of financial exclusion. Beyond account closures and freezing, derisking often includes blocking transactions and other financial services, all with the ultimate goal of hindering the flow of funds towards the Palestinian cause and Palestinian civil society. Such actions are part of a concerted effort to economically isolate and disempower entities associated with Palestinian advocacy. J\u00fcdische Stimme’s experience is a vivid example of this larger context, where financial strategies are used to marginalise and stifle support for Palestinian rights.<\/a>  <\/p>\n\n\n\n

Berliner Sparkasse, the bank that has now been ordered by the court to reopen J\u00fcdische Stimme’s bank account, has repeatedly demonstrated and continues to demonstrate their anti-Palestinian commitment. While it claims to celebrate and foster ”ethnic diversity in Berlin”, it hosts bank accounts of the far right Alternative f\u00fcr Deutschland Party as well as the Neo-Nazi Party Die HEIMAT and the Israeli lobby group ELNET. <\/p>\n\n\n\n

Furthermore, the state of Israel has recently thanked<\/a> the bank for posting an Israeli propaganda message through all their ATMs.  Berliner Sparkasse also collected donations<\/a> for the organisation J\u00fcdisches Forum f\u00fcr Demokratie und gegen Antisemitismus e.V. (Jewish Forum for Democracy and against anti-Semitism), which surveils Palestinians in Germany, targets them with smearing and regularly engages in racist, anti-Palestinian incitement such as Nakba denial<\/a>. <\/p>\n\n\n\n

Article VI of the Genocide Convention specifies that legal “persons” (including corporations) may be held liable for genocidal acts. Dr. Irene Pietropaoli, expert in Business and Human Rights at the British Institute of International and Comparative Law recently stated<\/a>: “These companies and their managers risk charges of complicity in genocide and other international crimes in their home States or international courts. Banks and other financial institutions that finance companies selling arms or other military supplies to the Israeli military or that provide funds directly to the Israeli State may also be contributing to the commission of genocide in Gaza.” <\/p>\n\n\n\n

We will continue to call out and take legal action against corporate complicity in the ongoing genocide in Palestine and Germany’s authoritarianism. <\/p>\n\n\n\n

DEUTSCH <\/p>\n\n\n\n

Sieg gegen die Komplizenschaft deutscher Unternehmen und dem Autoritarismus des deutschen Staates<\/strong> <\/h2>\n\n\n\n

Im Juni 2024 entschied das Kammergericht Berlin, dass die Sperrung und L\u00f6schung des Kontos des Vereins J\u00fcdische Stimme f\u00fcr gerechten Frieden in Nahost – EJJP Deutschland e. V.<\/a> durch die teilstaatliche Berliner Sparkasse rechtswidrig war. Die J\u00fcdische Stimme ist ein gemeinn\u00fctziger, unabh\u00e4ngiger j\u00fcdischer Verein, der als deutscher Zweig der Dachorganisation “European Jews for a Just Peace” (EJJP) agiert. <\/p>\n\n\n\n

Ahmed Abed, der Anwalt der J\u00fcdischen Stimme, erkl\u00e4rte: <\/p>\n\n\n\n

“Unter grobem Versto\u00df gegen die Vertragsbedingungen und das allgemeine Zivilrecht hatte die Bank das Konto des Vereins kurzfristig gesperrt und den Vertrag zum M\u00e4rz 2024 gek\u00fcndigt. Die Bank argumentierte, dass die Gesch\u00e4ftsbeziehung mit der J\u00fcdischen Stimme ihrem Ruf schaden k\u00f6nnte und eine K\u00fcndigung aufgrund von Geldw\u00e4sche- und Terrorfinanzierungsgesetzen notwendig sei, wof\u00fcr das Gericht keinerlei Grundlage fand.” <\/p>\n<\/blockquote>\n\n\n\n

Die Entscheidung der Bank, gegen die Menschenrechtsgruppe vorzugehen, ist im Zusammenhang mit dem beispiellosen autorit\u00e4ren Vorgehen gegen den Pal\u00e4stina Kongress<\/a> in Berlin zu verstehen. Der Pal\u00e4stina Kongress war als eine Versammlung pal\u00e4stinensischer, j\u00fcdischer, deutscher und internationaler Stimmen geplant, die ein Ende des israelischen V\u00f6lkermordes in Gaza forderten und die Mitschuld Deutschlands anprangerten. Er wurde schlie\u00dflich durch einen illegalen Angriff der deutschen Beh\u00f6rden unter einem enormen Polizeieinsatz verhindert. Die J\u00fcdische Stimme hatte zuvor \u00fcber ihr Bankkonto Spenden f\u00fcr den Pal\u00e4stina-Kongress verwaltet. In einer Erkl\u00e4rung nach der K\u00fcndigung des Kontos durch die Bank deutete die J\u00fcdische Stimme an, dass die Bank von der deutschen Polizei unter Druck gesetzt<\/a> worden sei, nachdem die Bank eine vollst\u00e4ndige Liste aller Mitglieder der Gruppe verlangt hatte. Die Gruppe wurde wiederholt von der deutschen Polizei schikaniert. <\/p>\n\n\n\n

Dar\u00fcber hinaus haben die deutschen Sicherheitsbeh\u00f6rden offensichtlich eine Reihe von extralegalen Ma\u00dfnahmen ergriffen, um den Kongress zu unterdr\u00fccken und zu beenden. Zu ihren besch\u00e4menden Ma\u00dfnahmen geh\u00f6ren die Einsch\u00fcchterung von Betreibern von Veranstaltungsr\u00e4umen, um sie unter Druck zur Ausladung der Veranstaltung zu treiben, das Verhindern der Teilnahme von Redner*innen, auch durch die Verh\u00e4ngung von Reiseverboten wie im Fall von Ghassan Abu-Sittah<\/a>, und nicht zuletzt die Razzia, die den Kongress schlie\u00dflich beendete.<\/a> <\/p>\n\n\n\n

Die deutschen Beh\u00f6rden handeln eindeutig au\u00dferhalb des Gesetzes und werden von zunehmend autorit\u00e4ren Politikern aktiv ermutigt. So hatte die deutsche Innenministerin Nancy Faeser (SPD) die Berliner Polizei offen gedr\u00e4ngt<\/a>, “hart gegen den Kongress vorzugehen”, und der Berliner B\u00fcrgermeister Kai Wegener (CDU) erkl\u00e4rte<\/a>: “Es ist unertr\u00e4glich, dass in Berlin ein so genannter Pal\u00e4stina-Kongress stattfindet”. <\/p>\n\n\n\n

Komplizenschaft der Unternehmen<\/strong> <\/h2>\n\n\n\n

Deutsche Beamte m\u00fcssen nicht unbedingt offen illegale Anordnungen verk\u00fcnden, sie k\u00f6nnen sich oft auf die Komplizenschaft von Unternehmen verlassen. Es ist nicht das erste Mal, dass eine gezielte Desinformationsskampagne deutscher Medien und deutscher Beh\u00f6rden zur Streichung des Bankkontos der J\u00fcdischen Stimme<\/a> gef\u00fchrt hat.<\/a> <\/p>\n\n\n\n

Dies ist Teil einer gr\u00f6\u00dferen Entwicklung, die als “Derisking”<\/em> bekannt ist und bei der Finanzinstitute Gesch\u00e4ftsbeziehungen einschr\u00e4nken oder beenden, um vermeintliche Risiken zu vermeiden. Diese Praxis hat insbesondere in F\u00e4llen zugenommen<\/a>, in denen Pal\u00e4stinenser*innen und pal\u00e4stinensische Organisationen betroffen sind, was ein systematisches Ph\u00e4nomen der finanziellen Ausgrenzung darstellt. Neben der Schlie\u00dfung und dem Einfrieren von Konten umfasst das Derisking h\u00e4ufig auch die Sperrung von Transaktionen und anderen Finanzdienstleistungen mit dem Ziel, den Fluss von Geldern f\u00fcr die pal\u00e4stinensische Sache und die pal\u00e4stinensische Zivilgesellschaft zu behindern. Solche Ma\u00dfnahmen sind Teil einer konzertierten Aktion zur wirtschaftlichen Isolierung und Entmachtung von Organisationen, die sich f\u00fcr die pal\u00e4stinensische Sache einsetzen. Die Vorg\u00e4nge rund um die J\u00fcdischen Stimme sind ein eindringliches Beispiel f\u00fcr dieses Ph\u00e4nomen, dem Einsatz finanzieller Unterdr\u00fcckung, um die Unterst\u00fctzung f\u00fcr die Rechte der Pal\u00e4stinenser*innen an den Rand zu dr\u00e4ngen und zu behindern.<\/a> <\/p>\n\n\n\n

Die Berliner Sparkasse, welche nun vom Gericht angewiesen wurde, das Konto der J\u00fcdischen Stimme wieder zu \u00f6ffnen, hat wiederholt ihr antipal\u00e4stinensisches Engagement unter Beweis gestellt und tut dies auch weiterhin. W\u00e4hrend sie behauptet, die “ethnische Vielfalt in Berlin” zu zelebrieren und zu f\u00f6rdern, f\u00fchrt sie Bankkonten der rechtsextremen Partei Alternative f\u00fcr Deutschland sowie der Neonazi-Partei Die HEIMAT und der israelischen Lobbygruppe ELNET.<\/strong> <\/p>\n\n\n\n

Au\u00dferdem hat sich der Staat Israel k\u00fcrzlich bei<\/a> der Bank daf\u00fcr bedankt<\/a>, dass sie an allen Geldautomaten eine israelische Propagandabotschaft ausgestrahlt hat. Die<\/a> Berliner Sparkasse sammelte auch Spenden<\/a> f\u00fcr die Organisation J\u00fcdisches Forum f\u00fcr Demokratie und gegen Antisemitismus e.V., die Pal\u00e4stinenser*innen in Deutschland \u00fcberwacht, sie gezielt verleumdet und regelm\u00e4\u00dfig rassistische, antipal\u00e4stinensische Hetze wie die Leugnung der Nakba<\/a> betreibt. <\/p>\n\n\n\n

Artikel VI der V\u00f6lkermordkonvention legt fest, dass juristische “Personen” (einschlie\u00dflich Unternehmen) f\u00fcr v\u00f6lkerm\u00f6rderische Handlungen haftbar gemacht werden k\u00f6nnen. Dr. Irene Pietropaoli, Expertin f\u00fcr Wirtschaft und Menschenrechte am Britischen Institut f\u00fcr internationales und vergleichendes Recht , erkl\u00e4rte k\u00fcrzlich<\/a>: “Diese Unternehmen und ihre Manager riskieren, in ihren Heimatstaaten oder vor internationalen Gerichten der Komplizenschaft bei V\u00f6lkermord und anderen internationalen Verbrechen angeklagt zu werden. Banken und andere Finanzinstitute, die Unternehmen finanzieren, die Waffen oder andere milit\u00e4rische G\u00fcter an das israelische Milit\u00e4r verkaufen, oder die dem israelischen Staat direkt Gelder zur Verf\u00fcgung stellen, tragen m\u00f6glicherweise ebenfalls zum V\u00f6lkermord in Gaza bei.” <\/p>\n\n\n\n

Wir werden auch weiterhin die Komplizenschaft von Unternehmen mit dem anhaltenden V\u00f6lkermord in Pal\u00e4stina und dem deutschen Autoritarismus anprangern und rechtliche Schritte dagegen einleiten. <\/p>\n\n\n\n
