Weeks later, it emerged that RIAS Berlin (an <a href=\"https:\/\/report-antisemitism.de\/en\/bundesverband-rias\/\" target=\"_blank\" rel=\"noopener\">organisation that \u201creports and monitors antisemitic incidents in Berlin<\/a>\u201d), along with MBR (an organisation \u201c<a href=\"https:\/\/mbr-berlin.de\/en\/25290-2\/\" target=\"_blank\" rel=\"noopener\">identifying and dealing with extreme right-wing, right-wing populism, racist and anti-Semitic behavior<\/a>\u201d) had <strong>surveilled her<\/strong> and <strong>privately processed her data<\/strong> to frame her as anti-Jewish racist, sexist and as a terrorist sympathiser. RIAS collected and distorted Dr. Younes\u2019 personal information, her academic publications on Israel-Palestine, and information pertaining to her alleged support to the BDS (Boycott-Divestment-Sanctions) movement which were available online. Using this personal data RIAS created a <strong>secret dossier<\/strong>, which was sent to the organisers of the event and resulted in her being uninvited. RIAS Berlin and MBR are two <a href=\"https:\/\/mbr-berlin.de\/en\/about-the-mbr\/\" target=\"_blank\" rel=\"noopener\">projects of the umbrella organisation VDK e.V.<\/a> (Society for a Democratic Culture in Berlin) and are funded by German public bodies.<\/p>\n\n\n\n<p>In March 2020, Dr. Younes requested access to her personal data from RIAS under European data protection law. This request was refused. Three months later, with the assistance of the European Legal Support Center (ELSC), she initiated complaint proceedings to<strong> the Berlin<\/strong> <strong>Data Protection Authority (DPA)<\/strong> against RIAS and MBR. The complaint requested that the DPA acknowledge the unlawfulness of RIAS&#8217; data processing and order it to provide Dr. Younes with the personal data it had collected. <strong>Over one and a half years later, the decision of the Berlin DPA is still pending. <\/strong>Dr. Younes, with her lawyer and the ELSC, decided to file <strong>a complaint against the DPA for its \u201cinactivity\u201d as well as a civil lawsuit against VDK<\/strong> <strong>e.V.<\/strong> to expedite the process. The first is already before the 1st Chamber of the Administrative Court of Berlin for decision, which deals, among other things, with data protection law, statistical surveys and disputes under the Stasi Records Act<a id=\"_ftnref1\" href=\"#_ftn1\">[1]<\/a>.<\/p>\n\n\n\n<p><strong>Other individuals have sent privacy-related requests to RIAS Berlin in fear that they are being observed<\/strong> and that secret papers are being created by RIAS about them due to their critical stances on Israeli domestic and foreign policy. Following the same pattern, RIAS denied having processed any of their data and claimed exemptions not to give access in any case. Unconvinced by this response, some of these parties concerned now <strong>intend to join Dr. Younes&#8217; action<\/strong>.<\/p>\n\n\n\n<p><em><strong>Last update, May 17, 2022:<\/strong> <\/em>The Berlin Data Protection Authority and VDK \u2013 the German state-funded organisation that legally represents RIAS Berlin and MBR \u2013 aknowledged Dr. Younes&#8217; right to access her data and VDK released the dossier. On 6 May 2022, the Berlin District Court upheld Dr. Younes\u2019 claims and ordered VDK to give Anna Younes access to data that the two civil society organisations had gathered on her and passed on to others. The information released so far reveals that RIAS and MBR have been collecting people\u2019s personal data based on their \u201cpositions on Israel and BDS.\u201d <strong><a href=\"https:\/\/elsc.support\/news\/german-court-rules-in-favour-of-scholar-dr-anna-younes-in-digital-surveillance-case\" target=\"_blank\" rel=\"noreferrer noopener\">Read more in our press release.<\/a><\/strong><\/p>\n\n\n\n<figure class=\"wp-block-embed aligncenter is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<iframe loading=\"lazy\" title=\"Censored and Surveilled: Repression of German-Palestinian Academic\" width=\"720\" height=\"405\" src=\"https:\/\/www.youtube.com\/embed\/mH6MmpPmmzo?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/div><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\">Controversial Issues at Stake<\/h2>\n\n\n\n<p>This case illustrates the increasing violation of democratic principles with respect to Palestinian rights advocates across Europe. It infringes on the <strong>right to privacy<\/strong>, <strong>freedom of expression and the participation in public life of anti-racist and decolonial advocates <\/strong>in Europe.<\/p>\n\n\n\n<p>We hope to draw attention to the <strong>defamation <\/strong>of Palestinian and decolonial voices, and their supporters, as well as to promote <strong>transparency and accountability <\/strong>within the framework of protection of <strong>democratic principles<\/strong>. The most relevant issues related to the case are addressed below.<\/p>\n\n\n<div id=\"accordion-block_44dd8b871b1ca5162079c579435266bd\"\n  class=\"accordion \">\n  <details class=\"accordion-details\">\n    <summary>Repression of Palestinian rights advocates    <\/summary>\n    <div class=\"accordion-content\">\n        <p>The censorship Dr. Younes is experiencing is <a href=\"https:\/\/www.theguardian.com\/commentisfree\/2021\/feb\/04\/artists-censored-germany-palestinian-rights\" target=\"_blank\" rel=\"noopener\">not an<\/a> isolated incident. It is symptomatic of a broader trend of repression, attacks, and <a href=\"https:\/\/www.972mag.com\/achille-mbembe-germany-israel-antisemitism\/\" target=\"_blank\" rel=\"noopener\">disinformation<\/a> <a href=\"https:\/\/www.theguardian.com\/commentisfree\/2021\/feb\/04\/artists-censored-germany-palestinian-rights\" target=\"_blank\" rel=\"noopener\">campaigns<\/a> against Palestinian rights advocates, and academics, particularly from minority ethnic backgrounds, in <a href=\"https:\/\/www.972mag.com\/germany-academia-bds-palestine\/\" target=\"_blank\" rel=\"noopener\">Germany<\/a>, the <a href=\"https:\/\/www.middleeasteye.net\/big-story\/uk-palestine-israel-policy-balfour-johnson-anitsemitism-colonialism\" target=\"_blank\" rel=\"noopener\">UK<\/a>, and across the \u2018Western\u2019 world. So far, the ELSC has monitored hundreds of cases of unfounded allegations of anti-Semitism against students, academics, activists in Germany, in The Netherlands, the UK, Austria, Italy, France, Belgium.<\/p>\n<p>This trend has grown following the adoption of <a href=\"https:\/\/www.nytimes.com\/2020\/12\/11\/arts\/germany-bds-open-letter.html\" target=\"_blank\" rel=\"noopener\">anti-BDS motions<\/a> in Germany by federal and regional parliaments, designating BDS as \u201cantisemitic\u201d and calling on public institutions to refuse funding and spaces for groups supporting BDS. By employing the notion of \u201cantisemitism\u201d, these motions stigmatise the BDS movement and Palestinian rights advocates, curtailing their fundamental rights to freedom of expression and assembly. This is having a <strong>chilling<\/strong> <strong>effect<\/strong> on Palestinian rights advocates, by intimidating and silencing them and the important cause for which they are advocating. This has the longstanding effect of <strong>erasing Palestinian human rights from the domain of legitimate public<\/strong> <strong>debate<\/strong>.<\/p>\n    <\/div>\n  <\/details>\n<\/div>\n\n<div id=\"accordion-block_41018ce1d02ffa67cbb338cee8de4914\"\n  class=\"accordion \">\n  <details class=\"accordion-details\">\n    <summary>Limitation of academic freedom    <\/summary>\n    <div class=\"accordion-content\">\n        <p>Academics are protected under the <a href=\"https:\/\/www.leru.org\/files\/Academic-Freedom-as-a-Fundamental-Right-Full-paper.pdf\" target=\"_blank\" rel=\"noopener\">right to<\/a> <a href=\"https:\/\/www.leru.org\/files\/Academic-Freedom-as-a-Fundamental-Right-Full-paper.pdf\" target=\"_blank\" rel=\"noopener\">academic freedom,<\/a> intended as the right to express their views and opinions, even if controversial or unpopular. The manner in which RIAS referred to Dr. Younes\u2019 peer-reviewed <a href=\"https:\/\/online.ucpress.edu\/caa\/article-abstract\/3\/1\/21\/25905\/A-gendered-movement-for-liberation-Hamas-s-women-s?redirectedFrom=fulltext\" target=\"_blank\" rel=\"noopener\">article <\/a>decontextualised her analysis, falsely misrepresented her argument, and framed her as a supporter of sexism and terrorism, infringing upon her academic freedom. The academic work in question falls within feminist post-colonial scholarship. It was not sexist and did not endorse terrorism, as testified in official documents reviewing Dr. Younes\u2019 work in light of these accusations.<\/p>\n<p>RIAS\u2019 effort to defame Dr. Younes included preventing Dr. Younes from publicly discussing her work on racism in Germany. We see this as a serious threat to her rights to academic freedom and freedom of expression. The ELSC has gathered extensive data showing how similar allegations have been employed to censor public debate in the UK and to repress academics who expose Israel\u2019s illegal policies and practices. Such tactics have tremendous consequences for the expression of critical thinking in democratic societies, education systems, and the maintenance of public debate in any democracy, which relies on plurality of opinions.<\/p>\n    <\/div>\n  <\/details>\n<\/div>\n\n<div id=\"accordion-block_965d1c6c76bb90e741828eea97c034dc\"\n  class=\"accordion \">\n  <details class=\"accordion-details\">\n    <summary>Unlawful interference with privacy rights    <\/summary>\n    <div class=\"accordion-content\">\n        <p><strong>RIAS\u2019 collection and processing of Dr. Younes\u2019 personal data amounts to surveillance<\/strong>. As the Advocate General of the European Court of Justice acknowledged, surveillance practices include the <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/PDF\/?uri=CELEX:62012CC0293&amp;from=EN\" target=\"_blank\" rel=\"noopener\">collection, processing and retention of personal data<\/a> without the subject\u2019s knowledge or consent. In the present case, RIAS\u2019 preparation of a secret dossier containing Dr. Younes\u2019 processed personal data, along with its subsequent distribution of the dossier to a third party, matches the foregoing features of surveillance. This creates a <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/PDF\/?uri=CELEX:62012CJ0293&amp;from=EN\" target=\"_blank\" rel=\"noopener\">chilling effect<\/a> on individuals&#8217; freedom of expression, as it has the apparent intention to instil the fear that one&#8217;s personal data may be constantly tracked. Moreover, <strong>the data processing carried out by RIAS is unlawful<\/strong>, <strong>because it violated several data processing principles laid down in Article 5 GDPR<\/strong>: principles of accuracy, purpose limitation, and transparency.<\/p>\n<p>The case of Dr. Younes shows that publicly funded bodies are able to secretly collect data on individuals and use it to limit their fundamental rights without <a href=\"https:\/\/ec.europa.eu\/newsroom\/article29\/items\/622227\" target=\"_blank\" rel=\"noopener\">transparency <\/a>or any accountability mechanism. By adopting a broad definition of anti-Jewish racism based on the <a href=\"https:\/\/www.holocaustremembrance.com\/resources\/working-definitions-charters\/working-definition-antisemitism\" target=\"_blank\" rel=\"noopener\">working definition of the International Holocaust<\/a> <a href=\"https:\/\/www.holocaustremembrance.com\/resources\/working-definitions-charters\/working-definition-antisemitism\" target=\"_blank\" rel=\"noopener\">Remembrance Alliance<\/a> (IHRA-WDA) and its <a href=\"https:\/\/fmep.org\/wp\/wp-content\/uploads\/Challenging-the-IHRA-Definition-of-Antisemitism.pdf\" target=\"_blank\" rel=\"noopener\">controversial<\/a> <a href=\"https:\/\/fmep.org\/wp\/wp-content\/uploads\/Challenging-the-IHRA-Definition-of-Antisemitism.pdf\" target=\"_blank\" rel=\"noopener\">examples, <\/a>this organisation includes Israel-critical scholarship or activism in its understanding of \u201cIsrael-related antisemitism\u201d. This position equates anti-Zionism with anti-Jewish racism, which results in <strong>categorising legitimate criticism of Israel\u2019s policies, racisms and colonialism as inherently \u201cantisemitic\u201d<\/strong>. This includes <a href=\"https:\/\/www.facebook.com\/AntisemitismusRechercheBerlin\/photos\/a.1463499907305026\/2993378217650513\/\" target=\"_blank\" rel=\"noopener\">slogans<\/a> such as \u201cFree Palestine\u201d and \u201cEnd support for Israel\u2019s occupation and apartheid regime\u201d or demonstrations against human rights violations conducted by the Israeli State.<\/p>\n<p>RIAS is a pivotal stakeholder when it comes to promoting the IHRA-WDA at the European level through the <a href=\"https:\/\/report-antisemitism.de\/en\/bundesverband-rias\/\" target=\"_blank\" rel=\"noopener\">RIAS Federal Association<\/a>. The European Commission and the International Holocaust Remembrance Alliance (IHRA)\u00a0\u201c<a href=\"https:\/\/ec.europa.eu\/newsroom\/just\/document.cfm?action=display&amp;doc_id=72262\" target=\"_blank\" rel=\"noopener\">commissioned<\/a> RIAS to develop a handbook on how the IHRA definition can be used in order to support Member States in their efforts to combat antisemitism\u201d. TAKE ACTION: <a href=\"https:\/\/t.co\/38XEK3B9F2\">https:\/\/t.co\/38XEK3B9F2<\/a> <a href=\"https:\/\/t.co\/IsM4aAWKaB\">pic.twitter.com\/IsM4aAWKaB<\/a><\/p>&mdash; European Legal Support Center (ELSC) (@elsclegal) <a href=\"https:\/\/twitter.com\/elsclegal\/status\/1511985120407871490?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"noopener\">April 7, 2022<\/a><\/blockquote><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script>\n<\/div><\/figure>\n\n\n<div id=\"accordion-block_684d6e9d1fb3456fc90970efe388f5c0\"\n  class=\"accordion \">\n  <details class=\"accordion-details\">\n    <summary>Timeline    <\/summary>\n    <div class=\"accordion-content\">\n        <p><strong>November 2019<\/strong>: Dr. Younes was disinvited from a public event about strategies against right-wing extremism in Germany. <span class=\"JsGRdQ\">Shortly after that, she learnt that RIAS Berlin and MBR sent a secret file to the organisers.<\/span><\/p>\n<p><strong>March 2020: <\/strong><span class=\"JsGRdQ\">Dr. Younes requested to access her personal data, as enshrined in European Data Protection Law.<\/span><\/p>\n<p><strong>April 2020:<\/strong> RIAS denied her request.<\/p>\n<p><strong>June 2020: <\/strong>Dr. Younes filed a complaint against RIAS Berlin and MBR before the Berlin Data Protection Authority.<\/p>\n<p><strong>2021-22: <\/strong><span class=\"JsGRdQ\">Other individuals who feared to be observed also sent RIAS Berlin data access requests. RIAS did not provide any clear answer and refused to give access, evading its obligations the same way it did with Dr. Younes&#8217;s request.<\/span><\/p>\n<p><strong>April 2022:<\/strong> Dr. Younes filed an administrative complaint against the Berlin Data Protection Authority and a civil lawsuit against VDK\/RIAS.<\/p>\n<p><strong>May 2022:<\/strong> The DPA took action and VDK\/RIAS gave access to the dossier. Berlin District Court aknowledged Dr. Younes&#8217; data rights and ordered VDK\/RIAS to give access to all personal data they collected about Dr. Younes. Anna Younes and her lawyer intend to request damages.<\/p>\n<p>A few days later, the DPA issued its final decision and issued a warning against VDK, representing RIAS Berlin and MBR. The DPA rejected RIAS\/MBR\u2019s claim and stated that they \u201c<em>did not have a serious scientific purpose<\/em>\u201d nor a journalistic one when preparing this dossier and found RIAS\/MBR violated European data protection law (GDPR).<\/p>\n<p><strong>2 November 2022:<\/strong> Dr. Younes files two new lawsuits: one to the Berlin Administrative Court to review the controversial DPA\u2019s decision and acknowledge that RIAS\/MBR\u2019s surveillance and false labelling of Dr. Younes as an anti-Jewish racist violated her right to privacy and right to reputation.
