On Monday, 27 January 2025<\/strong>, another case in the attempted criminalisation of the slogan \u2018Palestine will be free, from the river to the sea\u2019<\/strong>\u202fshould have been heard at the\u202fTiergarten District Court.<\/strong>\u202fThe Berlin public prosecutor had opened an investigation against\u202ffilmmaker Dror Dayan\u202f<\/strong>for the\u202f<\/strong>use of symbols of unconstitutional and terrorist organisations<\/em><\/strong>\u202f<\/strong>(\u00a7 86a\u202fStGB), pressing\u202fcharges. The case concerns a Twitter comment from November 2023, in which Dror Dayan denounced the criminalisation of the slogan in Germany.\u202f <\/p>\n\n\n\n

However, the judge postponed the ruling on spurious grounds, citing that an expert witness could not attend the trial for health reasons. The witness in question is a police officer in the Berlin State Criminal Police who had previously written and submitted an extensive report to clarify whether the slogan “Palestine will be free, from the river to the sea” constitutes a symbol of Hamas.  <\/p>\n\n\n\n

Importantly, the expert noted that the attempt to establish the use of the slogan as Hamas praxis would be reductive, highlighting that is had been used by a large political spectrum for many decades.  Moreover, after reviewing a sizeable number of Hamas publications, including those dating back to 1988, the year of the group\u2019s founding, the expert did not find a single publication which featured the slogan and thus concluded that there was no compelling evidence to claim that the slogan constituted a Hamas symbol.  <\/p>\n\n\n\n

Nadija Samour, Senior Legal Officer at the <\/strong>European Legal Support Center (ELSC) representing\u202fthe defendant comments:\u202f\u201cThis is highly suspicious. The expert had already delivered their report to the judge in a written form. The judge could have ruled that day. We suspect that the judge artificially prolonged the trial for political reasons, probably fearing repercussions. A ruling in our favour would constitute a legal precedent for other ongoing trials regarding the attempted criminalisation of the slogan \u2018Palestine will be free from the river to the sea\u2019. The judges seem avoidant to take a clear stance even though the police itself came to a clear conclusion.\u2019\u2019 <\/p>\n\n\n\n

Earlier, German Justice Minister Marco Buschmann had declared<\/a> that expressing the slogan constituted a crime. This came right after the administrative court Bremen had ruled<\/a> it was lawful. This must be considered an interference of the government in the judiciary. The tweet was widely understood as a warning and criticism of the court’s judgment. <\/p>\n\n\n\n

Not isolated cases: Germany\u2019s systematic repression of Palestine solidarity<\/strong> <\/p>\n\n\n\n

There are currently dozens of ongoing cases concerning the slogan \u201cPalestine will be free from the river to the sea\u2019\u2019, many of which have been artificially prolonged in similar ways<\/a>. Furthermore, expressions of the slogan, are currently variously charged as three separate criminal offences, including as \u2018incitement to hatred\u2019 (\u00a7 130 StGB), \u2018displaying symbols of unconstitutional organisations\u2019 (\u00a7 86a StGB) or \u2018endorsement of criminal acts\u2019 (\u00a7 140 StGB). This indicates that German authorities are politically motivated to criminalise the expression of the slogan, even if it does not clearly and conclusively meet any criminal offence defined in the German criminal code.   <\/p>\n\n\n\n

These are not isolated cases. German authorities have only been expanding their alarmingly violent measures to suppress the Palestine solidarity movement. The German Federal Minister of Interior Nancy Faeser<\/a>, for instance, declared the slogan illegal. <\/p>\n\n\n\n

In May 2024, the German Federal Ministry of Justice reiterated Nancy Faeser\u2019s decree<\/a> and declared the slogan to be a \u201cHamas slogan\u2019\u2019 and therefore punishable. Merely days after this declaration, the German state of North Rhine-Westphalia banned the Palestine Solidarity Duisburg<\/a> group over alleged support for Hamas for the group\u2019s use of the slogan. This resulted in several raids<\/a> targeting the homes of the activists in May 2024.  <\/p>\n\n\n\n

While much of the repression against the Palestine solidarity movement is issued at the German Federal level, the ruling Government of Germany\u2019s capital, Berlin, has been particularly eager to press for even more authoritarian measures.  For instance, the push to remove students from universities in Berlin, specifically in relation to Palestine solidarity on campus, should be of utmost concern as it effectively denies the right to education based on political beliefs.  <\/p>\n\n\n\n

Nevertheless, attempts to criminalise the slogan have been successfully pushed back against<\/a> in German courts. In June 2024, a court in Munich<\/a> reaffirmed the right to express the slogan ‘From the River to the Sea’ at demonstrations. <\/p>\n\n\n\n

Am Montag, den 27. Januar 2025<\/strong>, sollte vor dem Amtsgericht Tiergarten<\/strong> ein weiterer Fall der versuchten Kriminalisierung des Slogans \u201ePal\u00e4stina wird frei sein, vom Fluss bis zum Meer\u201c<\/strong> verhandelt werden.\u202fDie Berliner Staatsanwaltschaft hatte ein Ermittlungsverfahren gegen den Filmemacher Dror Dayan <\/strong>wegen Verwendung von Kennzeichen verfassungswidriger und terroristischer Organisationen<\/em><\/strong> (\u00a7 86a StGB) eingeleitet und Anklage erhoben. Der Prozess dreht sich um einen Twitter-Kommentar vom November 2023, in dem Dror Dayan die Kriminalisierung des Slogans in Deutschland anprangerte.\u202fDie Richterin vertagte die Entscheidung jedoch mit fadenscheinigen Begr\u00fcndungen, da angeblich eine Sachverst\u00e4ndige aus gesundheitlichen Gr\u00fcnden nicht an der Verhandlung teilnehmen k\u00f6nne. <\/p>\n\n\n\n

Bei der besagten Zeugin handelt es sich um eine Polizeibeamtin des Landeskriminalamts Berlin, die zuvor einen ausf\u00fchrlichen Bericht verfasst und vorgelegt hatte. Dieser sollte kl\u00e4ren, ob der Slogan \u201ePalestine will be free, from the river to the sea\u201c ein Symbol der Hamas darstellt.  <\/p>\n\n\n\n

Insbesondere merkte die Gutachterin an, es sei eine unzul\u00e4ssige Verk\u00fcrzung, den Slogan als Hamas-Symbol zu werten, da er seit vielen Jahrzehnten von einem breiten politischen Spektrum verwendet werde. Nach Durchsicht einer betr\u00e4chtlichen Anzahl von Hamas-Publikationen, die bis ins Gr\u00fcndungsjahr 1988 zur\u00fcckreichen, fand die Gutachterin zudem keine einzige Ver\u00f6ffentlichung, in der der Slogan vorkam. Sie kam daher zu dem Schluss, dass es keine \u00fcberzeugenden Belege daf\u00fcr gibt, den Slogan als Hamas-Symbol einzuordnen.  <\/p>\n\n\n\n

Nadija Samour, Senior Legal Officer beim <\/strong>European Legal Support Center (ELSC), die den Angeklagten vertritt, kommentiert: \u201eDas Ganze ist h\u00f6chst suspekt. Die Sachverst\u00e4ndige hatte dem Gericht ihren Bericht bereits in schriftlicher Form vorgelegt. Die Richterin h\u00e4tte an diesem Tag urteilen k\u00f6nnen. Wir vermuten, dass die Richterin das Verfahren aus politischen Gr\u00fcnden k\u00fcnstlich in die L\u00e4nge zieht, wahrscheinlich aus Angst vor Konsequenzen. Ein Urteil zu unseren Gunsten w\u00fcrde einen Pr\u00e4zedenzfall f\u00fcr andere laufende Verfahren zur versuchten Kriminalisierung des Slogans \u201ePalestine will be free from the river to the sea\u201c schaffen. Die Gerichte scheinen eine Entscheidung zu vermeiden, obwohl sogar die Polizei selbst zu einem eindeutigen Schluss gekommen ist.\u201c  <\/p>\n\n\n\n

Zuvor hatte der deutsche Justizminister Marco Buschmann erkl\u00e4rt,<\/a> dass die \u00c4u\u00dferung des Slogans eine Straftat darstelle. Dies geschah unmittelbar nachdem das Verwaltungsgericht Bremen entschieden hatte,<\/a> dass die Verwendung des Slogans rechtm\u00e4\u00dfig sei. Dies muss als Eingriff der Regierung in die Justiz angesehen werden. Der Tweet wurde weithin als Warnung und Kritik am Urteil des Gerichts verstanden.  <\/p>\n\n\n\n

Keine Einzelf\u00e4lle: Deutschlands systematische Unterdr\u00fcckung der Pal\u00e4stina-Solidarit\u00e4t<\/strong>  <\/p>\n\n\n\n

Derzeit gibt es Dutzende von laufenden Verfahren wegen dem Slogan \u201ePalestine will be free from the river to the sea\u201c, von denen viele auf \u00e4hnliche Weise<\/a> unn\u00f6tig in die L\u00e4nge gezogen werden. Dar\u00fcber hinaus werden \u00c4u\u00dferungen des Slogans derzeit auf dreierlei Weise als Straftatbest\u00e4nde verfolgt, darunter als Volksverhetzung (Paragraf 130 StGB), als Verwenden von Kennzeichen verfassungswidriger Organisationen (Paragraf 86a StGB) oder als Billigung von Straftaten (Paragraf 140 StGB). Dies deutet darauf hin, dass die deutschen Beh\u00f6rden politisch motiviert sind, die \u00c4u\u00dferung des Slogans zu kriminalisieren, auch wenn er eindeutig und abschlie\u00dfend keiner im deutschen Strafgesetzbuch definierten Straftat entspricht.  <\/p>\n\n\n\n

Dies sind keine Einzelf\u00e4lle. Die deutschen Beh\u00f6rden haben ihre alarmierend gewaltt\u00e4tigen Ma\u00dfnahmen zur Unterdr\u00fcckung der Pal\u00e4stina-Solidarit\u00e4tsbewegung nur ausgeweitet. So erkl\u00e4rte die deutsche Bundesinnenministerin Nancy Faeser<\/a> den Slogan f\u00fcr illegal. <\/p>\n\n\n\n

Im Mai 2024 bekr\u00e4ftigte das Bundesjustizministerium Nancy Faesers Erlass<\/a> und erkl\u00e4rte den Slogan zu einem \u201eHamas-Slogan\u201c und damit f\u00fcr strafbar. Nur wenige Tage nach dieser Erkl\u00e4rung verbot das Bundesland Nordrhein-Westfalen die Gruppe \u201ePal\u00e4stina Solidarit\u00e4t Duisburg<\/a>\u201c wegen angeblicher Hamas-Unterst\u00fctzung, weil die Gruppe den Slogan verwendet hatte. Dies f\u00fchrte im Mai 2024 zu mehreren Razzien<\/a> in den Wohnungen der Aktivist*innen.  <\/p>\n\n\n\n

W\u00e4hrend ein Gro\u00dfteil der repressiven Ma\u00dfnahmen gegen die Pal\u00e4stina-Solidarit\u00e4tsbewegung auf Bundesebene erlassen wird, ist die Regierung der Hauptstadt Berlin besonders darauf erpicht, auf noch autorit\u00e4rere Ma\u00dfnahmen zu dr\u00e4ngen. So sollte beispielsweise das Bestreben, Studierende von Berliner Universit\u00e4te im Zusammenhang mit Pal\u00e4stina-Solidarit\u00e4t auf dem Campus zu exmatrikulieren, Anlass zu gr\u00f6\u00dfter Sorge geben. Denn damit w\u00fcrde das Recht auf Bildung aufgrund politischer \u00dcberzeugungen verwehrt. <\/p>\n\n\n\n

Dennoch wurden Bestrebungen, den Slogan zu kriminalisieren, erfolgreich vor<\/a> deutschen Gerichten abgewehrt. Im Juni 2024 best\u00e4tigte ein Gericht in M\u00fcnchen<\/a> erneut das Recht, den Slogan \u201efrom the river to the sea\u201c bei Demonstrationen zu verwenden.  <\/p>\n\n\n\n

Der Verein J\u00fcdische Stimme f\u00fcr gerechten Frieden in Nahost e.V.<\/strong> hatte zu einer<\/a> Kundgebung vor dem Gerichtsgeb\u00e4ude<\/strong> aufgerufen, um gegen den Prozess und die deutsche Mitschuld an Israels V\u00f6lkermordkampagne in Pal\u00e4stina<\/strong> zu protestieren. <\/p>\n\n\n\n
