The case of Daria<\/em><\/p>\r\n\r\n\r\n\r\n

On 22nd<\/sup> August 2024, activist Daria will face her first hearing at the Berlin court Amtsgericht Tiergarten. She is accused of\u00a0 \u2018circulation of symbols of unconstitutional and terrorist organisations\u2019 (<\/strong>\u00a7 86 StGB)\u00a0for chanting the slogan \u201cPalestine will be free from the river to the sea\u201d at a demonstration on the 9th<\/sup> of March 2024.\u00a0<\/p>\r\n\r\n\r\n\r\n

Her case does not stand in isolation.<\/strong> Rather, it is one of many that are challenging the attempted criminalisation of the slogan \u2018\u2019Palestine will be free, from the river to the sea\u2019\u2019 by German authorities. This attempt clearly constitutes a political move to control and repress the Palestine solidarity movement in Germany as a whole.\u00a0<\/p>\r\n\r\n\r\n\r\n

\r\n

\u2018\u2019This is an attack on the freedom of expression and freedom of assembly and stands on a shaky legal basis. However, this is a highly political case, the court might seek to forward the case to a higher court by imposing a financial penalty on Daria in this first instance. We will then definitely appeal and expect to win at a higher tribunal.\u201d\u00a0<\/p>\r\n<\/blockquote>\r\n\r\n\r\n\r\n

A similar trial<\/a> had recently raised international attention<\/a>. Here, a Berlin court sentenced an activist to a fine for chanting \u2018Palestine will be free from the river to the sea\u2019 at a demonstration against racism in German schools. The court argued that because the demonstration happened on October 11th, using this slogan would constitute a criminal offence, referring to the \u2018endorsement of criminal acts\u2019. \u00a0<\/p>\r\n\r\n\r\n\r\n

\u2018\u2019Palestine will be free, from the river to the sea\u2019\u2019<\/a> is a call for Palestinian liberation and an end to genocidal settler-colonialism, apartheid, land grabbing and other forms of systematic oppression of the Palestinian people since at least 1948. Israeli officials regularly reiterate<\/a> the colonial logic to annihilate Palestinian existence on the land between the Jordan river and the Mediterranean Sea<\/a>, the historic Palestine. \u00a0<\/p>\r\n\r\n\r\n\r\n

In the past, German authorities have protected far right Israeli activists<\/a> using the slogan \u201cFrom the river to the sea\u201d as a call for Israeli supremacy and the annihilation of Palestine on multiple occasions. \u00a0<\/p>\r\n\r\n\r\n\r\n

At the same time, attempts to criminalise the slogan \u201cPalestine will be free, from the river to the sea\u201d, with several instances dating back to as early as 2022, are ever-growing. At the time, the conference of interior ministers<\/a> had declared that it would test and use all legal measures that allow a criminalisation of the use of the slogan to express Palestine solidarity. \u00a0<\/p>\r\n\r\n\r\n\r\n

This led to shocking levels of authoritarian state repression, as Daria explains:\u00a0<\/p>\r\n\r\n\r\n\r\n

\u00a0”The risk of a penalty fine is obviously not the most relevant consequence here. Police are using the quite severe offence charges to justify brutal violence against protestors. In the past few months, dozens of people have been beaten to a state of unconsciousness during police crackdowns and had to be hospitalized with severe injuries; some have had their homes raided just for saying “From the river to the sea”. \u00a0<\/p>\r\n\r\n\r\n\r\n

The criminalisation of the slogan is clearly an attempt to generate consent for the persecution of the Palestine solidarity movement and ultimately for the genocide in Palestine. More broadly, it is used to cement racist stereotypes and white supremacist mentality in the German societal consciousness. This is meant to pave the way for more fascistic politics, like the practical annulment of human rights for refugees, the police occupation of non-white neighbourhoods and\u00a0<\/p>\r\n\r\n\r\n\r\n

\u00a0the overall militarisation of police at the cost of defunding education and social services, just to name a few examples. \u00a0<\/p>\r\n\r\n\r\n\r\n

The persecution of the Palestine solidarity movement is not an isolated phenomenon but is part of a large-scale fascisation of this country and Europe as a whole, which will be affecting everybody soon enough. Very telling that the German public, of all countries, doesn’t care to recognise where this leads to.”\u00a0<\/p>\r\n\r\n\r\n\r\n

German authorities have only been expanding their alarmingly violent measures to suppress the Palestine solidarity movement. German Federal Minister of Interior Nancy Faeser<\/a>, for instance, has declared the slogan illegal and punishable as a crime with a prison sentence of up to three years by decree in November 2023, but it is usually punished with a fine upon conviction. \u00a0<\/p>\r\n\r\n\r\n\r\n

In May 2024, the German Federal Ministry of Justice reiterated Nancy Faeser\u2019s decree<\/a> and declared the slogan to be a \u2018\u2019Hamas slogan\u2019\u2019 and therefore punishable. Merely days after this declaration, the German state of North Rhine-Westphalia banned the group Palestine Solidarity Duisburg<\/a> over alleged support for Hamas for the group\u2019s use of the slogan. This resulted in several raids of the homes of activists in May 2024<\/a>. \u00a0<\/p>\r\n\r\n\r\n\r\n

The German ministry of Interior is further preparing a draconian migration law, which would effectively end free speech for nationals in Germany who do not carry the citizenship and pave the way for extensive online surveillance of migrants<\/a>. \u00a0<\/p>\r\n\r\n\r\n\r\n

The German parliament seems unwilling to prevent these developments and is preparing a declaration<\/a> which calls for extensive state repression of anyone vaguely expressing Palestine solidarity through criminalisation, but also through cutting cultural funding and interfering in academic research.\u00a0<\/p>\r\n\r\n\r\n\r\n

While much of the repression against the Palestine solidarity movement is issued on a German Federal level, the ruling Government of Germany\u2019s capital Berlin has been particularly eager to press for even more authoritarian measures. The absurd and ineffectual ban of red triangles<\/a> has raised eyebrows recently. Of outmost concern should be the push to remove students from universities in Berlin, effectively denying the right to education based on political grounds, specifically with relation to Palestine solidarity.\u00a0<\/p>\r\n\r\n\r\n\r\n

Nevertheless, attempts to criminalise the slogan have been pushed back against successfully<\/a> at German courts before. In June 2024, a court in Munich<\/a> granted a demonstration the right to express the slogan.\u00a0<\/p>\r\n\r\n\r\n\r\n

Activists will now accompany Daria\u2019s trial with a rally in front of the courthouse<\/a> on Thursday August 22 starting at 9:00 am. At a previous hearing in a different case on August 6, a huge group had gathered in support When the defendant left the court, dozens shouted in solidarity: From the river to the sea, Palestine will be free.\u00a0<\/p>\r\n\r\n\r\n\r\n

N\u00e4chster Prozess zur versuchten Kriminalisierung der Parole\u00a0\u201ePalestine will be free, from the river to the sea\u201c\u00a0in Deutschland \u00a0<\/strong><\/h2>\r\n\r\n\r\n\r\n

Am 22. August 2024 findet die erste Verhandlung gegen die Aktivistin Daria vor dem Berliner Amtsgericht Tiergarten statt. Ihr wird die \u201eVerbreitung von Kennzeichen verfassungswidriger und terroristischer Organisationen\u201c (<\/strong>\u00a7 86 StGB) vorgeworfen, weil sie bei einer Demonstration am 9. M\u00e4rz 2024 die Parole \u201ePalestine will be free, from the river to the sea\u201c skandiert hat. \u00a0<\/p>\r\n\r\n\r\n\r\n

Das ist kein Einzelfall.<\/strong> Vielmehr steht der Fall in einer Reihe \u00e4hnlicher Versuche deutscher Beh\u00f6rden zur Kriminalisierung der Parole \u201ePalestine will be free, from the river to the sea\u201c. Diese Versuche sind ein eindeutig politisch-motiviertes Man\u00f6ver zur Kontrolle und Unterdr\u00fcckung der Pal\u00e4stina-Solidarit\u00e4tsbewegung in Deutschland. \u00a0<\/p>\r\n\r\n\r\n\r\n

Die ELSC-Anw\u00e4ltin Nadija Samour vertritt Daria in dem Prozess. Nadija Samour kommentiert: \u00a0<\/p>\r\n\r\n\r\n\r\n

“Dies ist ein Angriff auf die Meinungs- und Versammlungsfreiheit und steht auf einer wankenden Rechtsgrundlage. Da es sich jedoch um einen hochpolitischen Fall handelt, k\u00f6nnte das Gericht versuchen, den Fall an ein h\u00f6heres Gericht weiterzuleiten, indem es Daria in erster Instanz eine Geldstrafe auferlegt. Wir werden dann auf jeden Fall in Berufung gehen und erwarten, dass wir vor einem h\u00f6heren Gericht gewinnen werden. ”\u00a0<\/p>\r\n<\/blockquote>\r\n\r\n\r\n\r\n

Ein \u00e4hnlicher Prozess<\/a> hat vor kurzem internationales Aufsehen erregt<\/a>. Ein Berliner Gericht verurteilte hierbei einen Aktivisten zu einer Geldstrafe, weil er bei einer Demonstration gegen Rassismus an deutschen Schulen \u201e Palestine will be free, from the river to the sea\u201c skandierte. Das Gericht argumentierte, dass die Verwendung dieses Slogans eine Straftat darstelle. Da die Demonstration am 11. Oktober stattfand, kurz auf den 7. Oktober,\u00a0w\u00e4\u00adre\u00a0die Verwendung des Slogans als \u201eBef\u00fcrwortung von Straftaten\u201c zu verstehen. \u00a0<\/p>\r\n\r\n\r\n\r\n

“<\/a>Palestine will be free, from the river to the sea”<\/a> ist ein Aufruf zur Befreiung Pal\u00e4stinas und zur Beendigung des v\u00f6lkerm\u00f6rderischen Siedlerkolonialismus, der Apartheid, des Landraubs und anderer Formen der systematischen Unterdr\u00fcckung des pal\u00e4stinensischen Volkes seit mindestens 1948. Israelische Beamte bekr\u00e4ftigen regelm\u00e4\u00dfig<\/a> die koloniale Absicht, die pal\u00e4stinensische Existenz im gesamten Land zwischen Jordan und Mittelmeer<\/a>, dem historischen Pal\u00e4stina, zu vernichten. \u00a0<\/p>\r\n\r\n\r\n\r\n

In der Vergangenheit haben deutsche Beh\u00f6rden<\/a> mehrfach rechtsextreme israelische Aktivist:innen gesch\u00fctzt<\/a>, die den Slogan \u201eVom Fluss zum Meer\u201c als Aufruf zur israelischen Vorherrschaft und zur Vernichtung Pal\u00e4stinas verwendeten. \u00a0<\/p>\r\n\r\n\r\n\r\n

Gleichzeitig nehmen die Versuche zu, die Parole \u201ePalestine will be free, from the river to the sea\u201c zu kriminalisieren, wobei mehrere F\u00e4lle bereits in das Jahr 2022 zur\u00fcckreichen. Zu dem Zeitpunkt hatte die Innenministerkonferenz<\/a> erkl\u00e4rt, sie werde alle rechtlichen Ma\u00dfnahmen pr\u00fcfen und anwenden, die eine Kriminalisierung der Verwendung der Parole als Ausdruck der Pal\u00e4stina-Solidarit\u00e4t erm\u00f6glichen. \u00a0<\/p>\r\n\r\n\r\n\r\n

Dies f\u00fchrte zu einem schockierenden Ausma\u00df an autorit\u00e4rer staatlicher Repression, wie Daria erkl\u00e4rt: \u00a0<\/p>\r\n\r\n\r\n\r\n

”Das Risiko eines Bu\u00dfgeldes ist hier offensichtlich nicht die h\u00e4rteste Konsequenz. Die Polizei rechtfertigt mit den Strafanzeigen brutale Gewalt gegen Demonstrant:innen. In den letzten Monaten wurden Dutzende bei Polizeirazzien bis zur Bewusstlosigkeit gepr\u00fcgelt und mussten mit schweren Verletzungen ins Krankenhaus eingeliefert werden. Bei einigen wurden Hausdurchsuchungen durchgef\u00fchrt, nur weil sie \u201eVom Fluss zum Meer\u201c gesagt hatten. \u00a0<\/p>\r\n\r\n\r\n\r\n

Die Kriminalisierung des Slogans ist eindeutig ein Versuch, Zustimmung zur Verfolgung der Pal\u00e4stina-Solidarit\u00e4tsbewegung und letztlich zum V\u00f6lkermord in Pal\u00e4stina zu mobilisieren. Im weiteren Sinne dient sie dazu, rassistische Stereotypen und White Supremacy-Denkweisen im deutschen gesellschaftlichen Bewusstsein zu zementieren. Damit soll der Weg f\u00fcr weitere faschistische Politik geebnet werden, wie die praktische Aufhebung der Menschenrechte f\u00fcr Gefl\u00fcchtete, die polizeiliche Belagerung nicht-wei\u00dfer Stadtviertel und die allgemeine Militarisierung der Polizei auf Kosten von Bildungs- und Sozialleistungen zeigen, um nur einige Beispiele zu nennen. \u00a0<\/p>\r\n\r\n\r\n\r\n

Die Verfolgung der Pal\u00e4stina-Solidarit\u00e4tsbewegung ist kein Einzelph\u00e4nomen, sondern Teil einer gro\u00dffl\u00e4chigen Faschisierung dieses Landes und Europas insgesamt, die schon bald alle betreffen wird. Es ist sehr bezeichnend, dass ausgerechnet die deutsche \u00d6ffentlichkeit nicht erkennen will, wohin das f\u00fchrt.\u201c \u00a0<\/p>\r\n\r\n\r\n\r\n

Die deutschen Beh\u00f6rden haben ihre erschreckend gewaltt\u00e4tigen Ma\u00dfnahmen zur Unterdr\u00fcckung der Pal\u00e4stina-Solidarit\u00e4tsbewegung nur noch ausgeweitet. So hat Bundesinnenministerin Nancy Faeser<\/a> die Parole im November 2023 per Erlass f\u00fcr illegal erkl\u00e4rt, die als Straftat mit einer Freiheitsstrafe von bis zu drei Jahren geahndet werden soll, wobei es bei einer Verurteilung jedoch in der Regel zu einer Geldstrafe kommt.\u00a0<\/p>\r\n\r\n\r\n\r\n

Im Mai 2024 bekr\u00e4ftigte das deutsche Bundesjustizministerium den Erlass von Nancy Faeser<\/a> und erkl\u00e4rte die Parole zu einer \u201eHamas-Parole\u201c und damit zu einer strafbaren Handlung. Nur wenige Tage nach dieser Erkl\u00e4rung verk\u00fcndete\u00a0das Bundesland Nordrhein-Westfalen das Verbot der Gruppe Pal\u00e4stina-Solidarit\u00e4t Duisburg<\/a> wegen angeblicher Unterst\u00fctzung der Hamas vor dem Hintergrund ihrer Verwendung der Parole. Dies f\u00fchrte im Mai 2024<\/a> zu mehreren Hausdurchsuchungen bei den Aktivist:innen<\/a>.\u00a0<\/p>\r\n\r\n\r\n\r\n

Zudem bereitet das deutsche Innenministerium ein drakonisches Migrationsgesetz vor, welches die freie Meinungs\u00e4u\u00dferung f\u00fcr nicht-deutsche Staatsangeh\u00f6rige in Deutschland effektiv beendet und den Weg f\u00fcr eine umfassende Online-\u00dcberwachung von Migrant*innen<\/a> ebnet.\u00a0<\/p>\r\n\r\n\r\n\r\n

Das deutsche Parlament scheint nicht gewillt zu sein, diese Entwicklungen zu verhindern. Stattdessen bereitet es eine Erkl\u00e4rung vor<\/a>, in der umfassende staatliche Repressionen gegen jede Person gefordert werden, die auch nur vage\u00a0 Pal\u00e4stina-Solidarit\u00e4t zum Ausdruck bringt. Diese beinhaltet Kriminalisierung, sowie auch die Streichung von Kulturf\u00f6rderung und Einschnitte in akademische Freiheiten. \u00a0<\/p>\r\n\r\n\r\n\r\n

W\u00e4hrend ein Gro\u00dfteil der Repressionen gegen die Pal\u00e4stina-Solidarit\u00e4tsbewegung auf bundesdeutscher Ebene erfolgt, hat die Berliner Landesregierung Berlin besonders eifrig auf noch autorit\u00e4rere Ma\u00dfnahmen gedr\u00e4ngt. Das absurde und nicht umsetzbare Verbot der roten Dreiecke<\/a> hat etwa in letzter Zeit f\u00fcr Stirnrunzeln gesorgt. Besonders besorgniserregend ist das Gesetz, welches es erlaubt Student:innen von Berliner Universit\u00e4ten zu exmatrikulieren und ihnen das Recht auf Bildung aus politischen Gr\u00fcnden, insbesondere im Hinblick auf Pal\u00e4stina-Solidarit\u00e4t, zu verweigern. \u00a0<\/p>\r\n\r\n\r\n\r\n

Einige Versuche die Parole zu kriminalisieren, wurden jedoch in der Vergangenheit vor deutschen Gerichten erfolgreich abgewehrt<\/a>. Im Juni 2024 sprach ein Gericht in M\u00fcnchen<\/a> einer Demonstration das Recht zu, die Parole zu rufen. \u00a0<\/p>\r\n\r\n\r\n\r\n

Aktivist:innen werden Darias Prozess mit einer Kundgebung vor dem Gerichtsgeb\u00e4ude<\/a> am Donnerstag, den 22. August ab 9:00 Uhr begleiten. Bei der Anh\u00f6rung in einem anderen Fall am 6. August hatte sich eine gro\u00dfe Gruppe zur Unterst\u00fctzung versammelt. Als die Angeklagte den Gerichtssaal verlie\u00df, wurde sie von Dutzenden solidarisch begr\u00fc\u00dft, und es erklang der laute Sprechchor: Palestine will be free from, the river to the sea.<\/p>\r\n\r\n\r\n\r\n
