{"id":2094,"date":"2022-07-11T09:57:38","date_gmt":"2022-07-11T07:57:38","guid":{"rendered":"https:\/\/cms.elsc.support\/cc_-elsc-newsletter-may-2022\/"},"modified":"2025-04-14T13:02:43","modified_gmt":"2025-04-14T11:02:43","slug":"cc_-elsc-newsletter-may-2022","status":"publish","type":"post","link":"https:\/\/elsc.support\/it\/cc_-elsc-newsletter-may-2022\/","title":{"rendered":"ELSC Newsletter: June 2022"},"content":{"rendered":"<p>This month, at least three cases confirmed, again, that public pressure and collective support, sometimes coupled with litigation, constitute a great tool to achieve our rights as advocates for Palestinian rights!<\/p>\n\n\n\n<div class=\"wp-block-buttons is-layout-flex wp-block-buttons-is-layout-flex\">\n<div class=\"wp-block-button aligncenter\"><a class=\"wp-block-button__link\" href=\"https:\/\/elsc.support\/it\/newsletter\/\" target=\"_blank\" rel=\"noreferrer noopener\">subscribe to our newsletter<\/a><\/div>\n<\/div>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>GERMAN AUTHORITY HOLDS RIAS AND MBR ACCOUNTABLE FOR VIOLATING ANNA YOUNES\u2019 DATA RIGHTS<\/strong><\/h2>\n\n\n\n<p>The Berlin Data Protection Authority (DPA) held German organisations RIAS Berlin and MBR accountable for violating the rights of German Palestinian scholar Dr. Anna-Esther Younes. The two organisations had previously <a href=\"https:\/\/support.us20.list-manage.com\/track\/click?u=0de9e0231539d1a4c5b3272e5&amp;id=2d1be96971&amp;e=fc68334d0d\" target=\"_blank\" rel=\"noopener\">circulated a secret dossier<\/a> which led to her disinvitation from a public event.<\/p>\n\n\n\n<p>Two years after Dr. Anna Younes filed a complaint to the DPA with our support, the DPA finally found that RIAS\/MBR violated European data protection law (GDPR) in refusing to give Dr. Younes access to the data they hold on her. RIAS\/MBR previously acknowledged that the purpose of the dossier was to identify Dr. Younes\u2019 positions on Israel and BDS. They secretly sent this dossier to a third party to get her disinvited.\u202fHowever, the DPA considered that this was lawful and that RIAS\/MBR pursued a legitimate purpose in collecting and transmitting information about Dr. Younes.<\/p>\n\n\n\n<h3 class=\"has-text-align-center wp-block-heading\"><strong>We will appeal this decision. GOETHE INSTITUTE<\/strong><\/h2>\n\n\n\n<p>The prominent Palestinian activist and poet <strong>Mohammed El Kurd faced an <\/strong><a href=\"https:\/\/support.us20.list-manage.com\/track\/click?u=0de9e0231539d1a4c5b3272e5&amp;id=3b3ea2d558&amp;e=fc68334d0d\" target=\"_blank\" rel=\"noopener\"><strong>attempt of censorship<\/strong><\/a> at a conference organised by the Goethe Institute in Hamburg about right-wing extremism and authoritarian regimes\u2019 tactics, where he was invited to speak. Few days before the start of the conference, the institution revoked the invitation, raising social media posts criticizing Israel that they \u201cdid not find acceptable\u201d. In solidarity with El Kurd, the curators of the conference Moshtari Hilal and Sinthujan Varatharajah <a href=\"https:\/\/support.us20.list-manage.com\/track\/click?u=0de9e0231539d1a4c5b3272e5&amp;id=02c95a09e7&amp;e=fc68334d0d\" target=\"_blank\" rel=\"noopener\">withdrew their participation and denounced<\/a> the climate of anti-Palestinian racism in German institutions. Thanks to this push back, many other participants of the event withdrew, which led to the entire program being scaled down.<\/p>\n\n\n\n<h3 class=\"has-text-align-center wp-block-heading\"><strong><a href=\"https:\/\/support.us20.list-manage.com\/track\/click?u=0de9e0231539d1a4c5b3272e5&amp;id=ecde5614b9&amp;e=fc68334d0d\" target=\"_blank\" rel=\"noreferrer noopener\">SHARE ON TWITTER<\/a><\/strong><\/h3>\n\n\n\n<h3 class=\"has-text-align-center wp-block-heading\"><strong><a rel=\"noreferrer noopener\" href=\"https:\/\/support.us20.list-manage.com\/track\/click?u=0de9e0231539d1a4c5b3272e5&amp;id=60e7d9bc6b&amp;e=fc68334d0d\" target=\"_blank\">SHARE ON INSTAGRAM<\/a><\/strong><\/h3>\n\n\n\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<h2 class=\"wp-block-heading\"><strong><strong>OTHER CASE UPDATES IN GERMANY<\/strong><\/strong><\/h2>\n\n\n\n<p>We also celebrate a <strong>victory in Stuttgart<\/strong> this month, as the City of Stuttgart decided it will not appeal the decision issued by the Stuttgart Administrative Court on 21 April 2022 in favour of the Stuttgart Palestine Committee. The Court had upheld the Committee\u2019s complaint against the City\u2019s decision to remove their access and details from the Municipality\u2019s website.<br>&nbsp;<br>This incident had happened following a smear campaign launched by the Jerusalem Post against the Committee because of its support to the Palestinian-led BDS movement. The City of Stuttgart had justified its decision citing the Bundestag\u2019s anti-BDS resolution, while the Court had <strong>recalled that the BDS movement is protected by freedom of expression and that the Bundestag\u2019s resolution is not binding<\/strong>.<\/p>\n\n\n\n<h3 class=\"has-text-align-center wp-block-heading\"><strong><a href=\"https:\/\/support.us20.list-manage.com\/track\/click?u=0de9e0231539d1a4c5b3272e5&amp;id=a71985fc44&amp;e=fc68334d0d\" target=\"_blank\" rel=\"noreferrer noopener\">READ MORE<\/a><\/strong><\/h3>\n\n\n\n<p>But this time, the City acknowledged the illegality of their decision. One of their spokespersons <a href=\"https:\/\/support.us20.list-manage.com\/track\/click?u=0de9e0231539d1a4c5b3272e5&amp;id=7ff07908ba&amp;e=fc68334d0d\" target=\"_blank\" rel=\"noopener\">said<\/a>: <\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p><em>for purely legal reasons, we have decided not to appeal against it. Based on the current jurisprudence, as it has been elsewhere, we estimate the chances of being successful with an appeal to be very low. The cancellation of her lecture followed a smear campaign on social media and a complaint from pro-Israel advocacy groups. Art media <a href=\"https:\/\/support.us20.list-manage.com\/track\/click?u=0de9e0231539d1a4c5b3272e5&amp;id=8039a7ffe4&amp;e=fc68334d0d\" target=\"_blank\" rel=\"noopener\">Art Forum<\/a> and <a href=\"https:\/\/support.us20.list-manage.com\/track\/click?u=0de9e0231539d1a4c5b3272e5&amp;id=b171569440&amp;e=fc68334d0d\" target=\"_blank\" rel=\"noopener\">Hyperallergic<\/a> wrote about the episode.<\/p>\n\n\n\n<p><br>Hundreds of&nbsp;<a href=\"https:\/\/docs.google.com\/document\/d\/e\/2PACX-1vQAW2uyLHSkkbVhc12EdvaiPhY-3jTl28_ZOY4JC2coZP9FTFzd6T3KwO8kQIV2pF0xDRUysFSyykl-\/pub\" target=\"_blank\" rel=\"noreferrer noopener\">artists, writers and&nbsp;academics<\/a>, including Judith Butler, Roger Waters, Angela Davis and Dirk Moses, have voiced&nbsp;their outrage in the wake of the last-minute cancellation, which pushed one of the co-curators to remove the remainder of the program from the premises of the cancelling institutions. Nevertheless, the Fine Arts Academy and the MUMOK still have not stepped back on their statement, nor recognised the damage done to Dr. Alqaisiya\u2019s reputation. One year ago, Peter Bolton published <a href=\"https:\/\/support.us20.list-manage.com\/track\/click?u=0de9e0231539d1a4c5b3272e5&amp;id=f8c1283b90&amp;e=fc68334d0d\" target=\"_blank\" rel=\"noopener\">a piece<\/a> denouncing the continuous smear campaigns and unfounded allegations of antisemitism made against the Left in the UK.<\/p>\n\n\n\n<p>Following that, Peter Bolton became himself the target of similar unfounded allegations on Twitter. A fake Twitter account started to spread smears against the journalist, which were amplified by other accounts and retweeted many times.
