{"id":4214,"date":"2025-03-20T11:39:39","date_gmt":"2025-03-20T10:39:39","guid":{"rendered":"\/?p=4214"},"modified":"2025-04-14T12:30:26","modified_gmt":"2025-04-14T10:30:26","slug":"anti-palestinian-repression-in-german-companies-censorship-and-intimidation-at-zalando","status":"publish","type":"post","link":"https:\/\/elsc.support\/fr\/anti-palestinian-repression-in-german-companies-censorship-and-intimidation-at-zalando\/","title":{"rendered":"Anti-Palestinian Repression in German companies \u2013 censorship and intimidation at Zalando \u00a0"},"content":{"rendered":"<p><strong>Zalando fires an Arab employee for objecting to their statements in support of Israel<\/strong>&nbsp;<\/p>\n\n\n\n<p>Berlin \u2013 On December 5<sup>th<\/sup>, 2024, the labour court Berlin (<em>Arbeitsgericht Berlin<\/em>) has settled the case of Mohamad S. supported by the European Legal Support Center (ELSC). Mohamad is a marketing professional and was working at Zalando SE in Berlin as a Senior Media Testing manager but received a termination of his contract following his expression of solidarity with Palestine.&nbsp;<\/p>\n\n\n\n<p>It all started with the worker\u2019s council as well as the management board posting biased \u201csolidarity with Israel\u201d statements on internal channels days after October 7<sup>th<\/sup>, 2023. Mohamed, as well as other individuals and groups such as \u201cMuslim community Zalando\u201d and \u201cBlack community Zalando\u201d objected to these statements mostly by expressing criticism in the comments section, exercising their freedom of speech. &nbsp;<\/p>\n\n\n\n<p>Comments were then closed, sometimes deleted, and general statements along the lines of \u201clet\u2019s keep politics out\u201d were posted. Nevertheless, what followed were clear signs of isolation at work. Mohamad and others were pushed out of projects, disinvited from meetings, and ostracised in personal communication. Mohamad was also repeatedly pressured to resign from the company. When the attempts to push him out of the company failed, he finally received a termination letter in June 2024 and decided to file a lawsuit against unfair dismissal. Furthermore, Mohamad filed an anti-discrimination complaint case, which was settled in the second hearing on December 5<sup>th<\/sup> as well.&nbsp;<\/p>\n\n\n\n<p>During the first hearing at the Berlin Labour Court, on 14 August 2024, it became clear that Zalando\u2019s termination of Mohamad\u2019s contract was unlawful and based on vague accusations of misconduct to justify the dismissal. When questioned, the company argued this libellous accusation was based on him saying \u201cYallah\u201d to another person. &nbsp;&nbsp;<\/p>\n\n\n\n<p>Mohamad holds a Lebanese nationality and was heavily affected by Israel\u2019s latest assault on his country. He has been living in Germany since 2022, holding a central position at Zalando\u2019s marketing department&nbsp;<\/p>\n\n\n\n<p>Mohamad comments: &#8220;At some point, I was told by HR, that \u201cmisogyny is part of my culture&#8221;. The particularities of this incident showed a repulsive bigotry by Zalando&#8217;s management and HR in its blatancy and audacity but are by no means unique. Zalando Muslims have faced pressure to self-censor their pro-Palestine support on their personal social media accounts, causing many to leave the company, while Muslim employees (constituting some 40% of the workforce in some German warehouses) increasingly report challenges in securing reasonable accommodations for their religious practices since October 2023.&#8221;&nbsp;<\/p>\n\n\n\n<p><strong>Racist discrimination at Zalando as a typical example of German corporate environment&nbsp;<\/strong>&nbsp;<\/p>\n\n\n\n<p>Zalando is not an exception but a typical example of the racist anti-Palestinian and anti-Arab corporate environment in Germany. Employees in German companies risk being fired for posting about Palestine online. A well-known example of this is football player Anwar El Ghazi, <a href=\"https:\/\/www.swr.de\/sport\/fussball\/fsv-mainz-05\/rechtsstreit-spende-el-ghazi-mainz-05-100.html\" target=\"_blank\" rel=\"noreferrer noopener\">who recently won a court case<\/a> concerning the termination of his contract. In this environment, racialised people (Muslims, Arabs, PoCs) are especially at risk, often being <a href=\"https:\/\/elsc.support\/fr\/cases\/germany-a-concerning-case-of-censorship-and-digital-surveillance\/\" target=\"_blank\" rel=\"noreferrer noopener\">monitored<\/a>, systematically marginalised, attacked, and pushed into silence.&nbsp;&nbsp;<\/p>\n\n\n\n<p>There is a powerful racist trope at play here: \u201cimported antisemitism\u201d. Many Germans implicitly or explicitly claim migrants (from Arab\/Muslim countries) are inherently antisemitic and must be disciplined by the \u2018\u2019enlightened German\u2019\u2019 who has \u201clearned from the past\u201d. For example, German vice chancellor and Minister for economic affairs <a href=\"https:\/\/www.bbc.com\/news\/world-europe-67296414\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a> Muslim groups had been &#8220;too hesitant&#8221; in distancing themselves from Hamas or antisemitism. German racist chauvinism is institutionalised in many and often absurd ways, such as <a href=\"https:\/\/edition.cnn.com\/2024\/06\/27\/europe\/german-citizens-israel-right-to-exist-intl\/index.html\" target=\"_blank\" rel=\"noreferrer noopener\">demanding that new citizens accept Israel\u2019s right to exist<\/a> but also shockingly authoritarian <a href=\"https:\/\/www.jacobin.de\/artikel\/abschiebungen-nancy-faeser-terror-verherrlichung-like-soziale-medien\" target=\"_blank\" rel=\"noreferrer noopener\">surveillance of migrants<\/a>. These practices foster a <a href=\"https:\/\/www.newarab.com\/analysis\/inside-germanys-far-reaching-anti-palestinian-crackdown\" target=\"_blank\" rel=\"noreferrer noopener\">culture of denunciation<\/a>,as is visible in many sectors of German society, from media to academia and <a href=\"https:\/\/www.versobooks.com\/blogs\/news\/a-statement-from-berlin-culture-workers-for-palestine%3fsrsltid=AfmBOorkRw2tsfYDUzvuDnVADkpMkfSujJWNwg601iK8P3wvvjWds0cJ\" target=\"_blank\" rel=\"noreferrer noopener\">cultural institutions<\/a> (<a href=\"https:\/\/www.euronews.com\/culture\/2023\/12\/20\/german-cultural-institutions-turn-on-pro-palestinian-voices\" target=\"_blank\" rel=\"noreferrer noopener\">see also<\/a> for further reference). We should understand these in the <a href=\"https:\/\/www.palestine-studies.org\/en\/node\/234763\" target=\"_blank\" rel=\"noreferrer noopener\">larger context<\/a> of <a href=\"https:\/\/www.greenleft.org.au\/content\/germany-silences-pro-palestinian-voices-while-profiting-arms-sales-israel\" target=\"_blank\" rel=\"noreferrer noopener\">economic<\/a> and political German interests and border regimes. &nbsp;<\/p>\n\n\n\n<p>Threats to residency status and\/or naturalisation are essential in this context as they are often connected to employment contracts. This leaves many people scared to speak up and can lead to serious consequences for people\u2019s livelihoods whenever they do speak up. Discriminatory dismissals, such as in the case of Mohamad, are often illegal and can be fought. The European Legal Support Center <a href=\"https:\/\/elsc.support\/fr\/cases\/berlin-court-finds-deutsche-welle-unlawfully-dismissed-journalist-farah-maraqa\/\" target=\"_blank\" rel=\"noreferrer noopener\">successfully reversed similar cases<\/a> in court. We encourage employees to speak out, to keep records of the repression by an employer wherever it occurs, and to reach out to the ELSC for legal support or advice.&nbsp;<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"has-larger-font-size\"><strong>Antipal\u00e4stinensische Repression in deutschen Unternehmen \u2013 Zensur und Einsch\u00fcchterung bei Zalando<\/strong>&nbsp;&nbsp;<\/p>\n\n\n\n<p><strong>Zalando entl\u00e4sst arabischen Mitarbeiter, weil er sich gegen die Unterst\u00fctzungsbekundungen f\u00fcr Israel aussprach<\/strong>&nbsp;<\/p>\n\n\n\n<p>Berlin \u2013 Am 5. Dezember 2024 hat das<em> Arbeitsgericht Berlin<\/em> den Fall von Mohamad S., der vom European Legal Support Center (ELSC) unterst\u00fctzt wurde, beigelegt. Mohamad ist Marketingfachmann und arbeitete bei Zalando SE in Berlin als Senior Media Testing Manager, erhielt jedoch eine K\u00fcndigung seines Vertrags, nachdem er Solidarit\u00e4t mit Pal\u00e4stina ge\u00e4u\u00dfert hatte.&nbsp;<\/p>\n\n\n\n<p>Es begann damit, dass der Betriebsrat und der Vorstand wenige Tage nach dem 7. Oktober 2023 tendenzi\u00f6se \u201eSolidarit\u00e4tsbekundungen mit Israel\u201c auf internen Kan\u00e4len ver\u00f6ffentlichten. Mohamed sowie andere Einzelpersonen und Gruppen wie die \u201eMuslimische Gemeinschaft Zalando\u201c und die \u201eSchwarze Gemeinschaft Zalando\u201c lehnten diese \u00c4u\u00dferungen ab. Sie machten von ihrem Recht auf freie Meinungs\u00e4u\u00dferung Gebrauch und kritisierten die Statements in den Kommentarspalten.&nbsp;<\/p>\n\n\n\n<p>Die Kommentare wurden daraufhin geschlossen, teilweise gel\u00f6scht und allgemeine Aussagen wie \u201eLasst uns die Politik raushalten\u201c gepostet. Dennoch folgten klare Zeichen der Isolation am Arbeitsplatz. Mohamad und andere wurden aus Projekten gedr\u00e4ngt, von Besprechungen ausgeladen und in pers\u00f6nlicher Kommunikation ausgegrenzt. Mohamad wurde auch wiederholt dazu gedr\u00e4ngt, das Unternehmen zu verlassen. Als es nicht gelang, ihn aus dem Unternehmen zu dr\u00e4ngen, erhielt er schlie\u00dflich im Juni 2024 ein K\u00fcndigungsschreiben. Er beschloss, eine Klage wegen rechtswidriger K\u00fcndigung einzureichen. Dar\u00fcber hinaus reichte Mohamad eine Antidiskriminierungsbeschwerde ein, die in der zweiten Anh\u00f6rung am 5. Dezember ebenfalls beigelegt wurde.&nbsp;<\/p>\n\n\n\n<p>Bei der ersten Anh\u00f6rung vor dem Arbeitsgericht Berlin am 14. August 2024 wurde deutlich, dass die K\u00fcndigung von Mohamads Vertrag durch Zalando rechtswidrig war. Sie beruhte auf vagen Vorw\u00fcrfen wegen Fehlverhaltens, um die K\u00fcndigung zu rechtfertigen. Auf Nachfrage argumentierte das Unternehmen, die diffamierenden Anschuldigungen beruhen etwa darauf, dass er zu einer anderen Person \u201eYallah\u201c gesagt habe.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Mohamad ist libanesischer Staatsb\u00fcrger und war stark betroffen von Israels j\u00fcngstem Angriff auf sein Land. Seit 2022 lebt er in Deutschland und hatte eine zentrale Position in der Marketingabteilung von Zalando inne.&nbsp;<\/p>\n\n\n\n<p>Mohamad kommentiert: \u201eIrgendwann wurde mir von der Personalabteilung gesagt, dass \u201aMisogynie Teil meiner Kultur sei\u2018. Die Einzelheiten dieses Vorfalls offenbaren eine absto\u00dfende Borniertheit seitens der Gesch\u00e4ftsf\u00fchrung und der Personalabteilung von Zalando, die in ihrer Schamlosigkeit und Dreistigkeit jedoch keineswegs einzigartig ist. Muslimische Zalando-Mitarbeiter*innen wurden dazu gedr\u00e4ngt, ihre pro-pal\u00e4stinensische Haltung in ihren pers\u00f6nlichen Social-Media-Konten zu zensieren. Das veranlasste viele dazu, das Unternehmen zu verlassen. Muslimische Mitarbeiter*innen (die in einigen deutschen Lagerh\u00e4usern etwa 40 % der Belegschaft ausmachen) berichten seit Oktober 2023 zunehmend von Schwierigkeiten, angemessene Arbeitsbedingungen f\u00fcr ihre religi\u00f6sen Br\u00e4uche zu erhalten.&#8221;&nbsp;<\/p>\n\n\n\n<p><strong>Rassistische Diskriminierung bei Zalando ist typisches Beispiel f\u00fcr das Arbeitsklima in deutschen Unternehmen<\/strong>&nbsp;<\/p>\n\n\n\n<p>Zalando ist keine Ausnahme, sondern ein typisches Beispiel f\u00fcr das rassistische, anti-pal\u00e4stinensische und anti-arabische Betriebsklima in Deutschland. Mitarbeiter*innen in deutschen Unternehmen riskieren, entlassen zu werden, sobald sie online etwas \u00fcber Pal\u00e4stina posten. Ein bekanntes Beispiel hierf\u00fcr ist der Fu\u00dfballspieler Anwar El Ghazi, <a href=\"https:\/\/www.swr.de\/sport\/fussball\/fsv-mainz-05\/rechtsstreit-spende-el-ghazi-mainz-05-100.html\" target=\"_blank\" rel=\"noreferrer noopener\">der k\u00fcrzlich einen Gerichtsprozess<\/a> \u00fcber die K\u00fcndigung seines Vertrags gewonnen hat. Vor diesem Hintergrund sind rassifizierte Menschen (Muslime, Araber, PoC) besonders gef\u00e4hrdet, da sie h\u00e4ufig <a href=\"https:\/\/elsc.support\/fr\/cases\/germany-a-concerning-case-of-censorship-and-digital-surveillance\/\" target=\"_blank\" rel=\"noreferrer noopener\">\u00fcberwacht<\/a>, systematisch ausgegrenzt, angegriffen und zum Schweigen gebracht werden.&nbsp;<\/p>\n\n\n\n<p>Hier kommt ein m\u00e4chtiger rassistischer Topos zum Tragen: \u201eimportierter Antisemitismus\u201c. Viele Deutsche behaupten implizit oder explizit, dass Migrant*innen (aus arabischen\/muslimischen L\u00e4ndern) von Natur aus antisemitisch seien und von den \u201eaufgekl\u00e4rten Deutschen\u201c, die \u201eaus der Vergangenheit gelernt haben\u201c, diszipliniert werden m\u00fcssten. So <a href=\"https:\/\/www.bbc.com\/news\/world-europe-67296414\" target=\"_blank\" rel=\"noreferrer noopener\">sagte der<\/a> deutsche Vizekanzler und Wirtschaftsminister beispielsweise, dass muslimische Verb\u00e4nde \u201ezu z\u00f6gerlich\u201c seien, sich von Hamas oder Antisemitismus zu distanzieren. Der rassistische Chauvinismus in Deutschland ist auf vielf\u00e4ltige und oft absurde Weise institutionalisiert, z. B. durch die <a href=\"https:\/\/edition.cnn.com\/2024\/06\/27\/europe\/german-citizens-israel-right-to-exist-intl\/index.html\" target=\"_blank\" rel=\"noreferrer noopener\">Forderung, dass neue B\u00fcrger das Existenzrecht Israels akzeptieren<\/a>, aber auch durch erschreckend autorit\u00e4re <a href=\"https:\/\/www.jacobin.de\/artikel\/abschiebungen-nancy-faeser-terror-verherrlichung-like-soziale-medien\" target=\"_blank\" rel=\"noreferrer noopener\">\u00dcberwachung von Migranten<\/a>. Diese Praktiken f\u00f6rdern eine <a href=\"https:\/\/www.newarab.com\/analysis\/inside-germanys-far-reaching-anti-palestinian-crackdown\" target=\"_blank\" rel=\"noreferrer noopener\">Kultur de<\/a>s<a href=\"https:\/\/www.newarab.com\/analysis\/inside-germanys-far-reaching-anti-palestinian-crackdown\" target=\"_blank\" rel=\"noreferrer noopener\"> Denunziat<\/a>entums. Dies wird in vielen Bereichen der deutschen Gesellschaft sichtbar, von Medien \u00fcber Wissenschaft bis hin zu <a href=\"https:\/\/www.versobooks.com\/blogs\/news\/a-statement-from-berlin-culture-workers-for-palestine%3fsrsltid=AfmBOorkRw2tsfYDUzvuDnVADkpMkfSujJWNwg601iK8P3wvvjWds0cJ\" target=\"_blank\" rel=\"noreferrer noopener\">kulturellen Einrichtungen<\/a> (<a href=\"https:\/\/www.euronews.com\/culture\/2023\/12\/20\/german-cultural-institutions-turn-on-pro-palestinian-voices\" target=\"_blank\" rel=\"noreferrer noopener\">siehe auch<\/a> f\u00fcr weitere Informationen). Wir m\u00fcssen diese Entwicklungen im <a href=\"https:\/\/www.palestine-studies.org\/en\/node\/234763\" target=\"_blank\" rel=\"noreferrer noopener\">gr\u00f6\u00dferen Kontext<\/a> der <a href=\"https:\/\/www.greenleft.org.au\/content\/germany-silences-pro-palestinian-voices-while-profiting-arms-sales-israel\" target=\"_blank\" rel=\"noreferrer noopener\">wirtschaftlichen<\/a> und politischen Interessen Deutschlands und seiner Grenzregime verstehen.&nbsp;<\/p>\n\n\n\n<p>Die Bedrohung des Aufenthaltsstatus und\/oder der Einb\u00fcrgerung ist in diesem Zusammenhang von entscheidender Bedeutung, da sie oft mit Arbeitsvertr\u00e4gen verbunden ist. Viele Menschen haben Angst, sich frei zu \u00e4u\u00dfern. Wenn sie es doch tun, kann dies schwerwiegende Folgen f\u00fcr ihren Lebensunterhalt haben. Diskriminierende K\u00fcndigungen, wie im Fall von Mohamad, sind oft illegal und k\u00f6nnen angefochten werden. Das European Legal Support Center hat <a href=\"https:\/\/elsc.support\/fr\/cases\/berlin-court-finds-deutsche-welle-unlawfully-dismissed-journalist-farah-maraqa\/\" target=\"_blank\" rel=\"noreferrer noopener\">\u00e4hnliche F\u00e4lle<\/a> vor Gericht <a href=\"https:\/\/elsc.support\/fr\/cases\/berlin-court-finds-deutsche-welle-unlawfully-dismissed-journalist-farah-maraqa\/\" target=\"_blank\" rel=\"noreferrer noopener\">erfolgreich <\/a>aufgehoben. Wir ermutigen Arbeitnehmer*innen, sich zu \u00e4u\u00dfern und alle auftretenden Repressionen durch Arbeitgeber zu dokumentieren.
