{"id":3352,"date":"2024-05-15T11:58:01","date_gmt":"2024-05-15T09:58:01","guid":{"rendered":"https:\/\/cms.elsc.support\/?p=3352"},"modified":"2024-05-15T13:47:32","modified_gmt":"2024-05-15T11:47:32","slug":"appeal-to-the-spanish-government","status":"publish","type":"post","link":"https:\/\/elsc.support\/de\/appeal-to-the-spanish-government\/","title":{"rendered":"Appeal to the Spanish government"},"content":{"rendered":"<p>We are a collective of lawyers in Germany who have recently filed an <a href=\"https:\/\/donorbox.org\/no-weapons-for-genocide-support-our-new-legal-battle-against-germany-s-arms-exports-to-israel\" data-type=\"link\" data-id=\"https:\/\/donorbox.org\/no-weapons-for-genocide-support-our-new-legal-battle-against-germany-s-arms-exports-to-israel\" target=\"_blank\" rel=\"noopener\">urgent appeal against the arms shipments from Germany to Israel <\/a>before the Berlin Administrative Court.<\/p>\n\n\n\n<p>We were informed by activists that the cargo ship \u201cBorkum\u201d will dock in Cartagena today &#8211; Wednesday, May 15, 2024 &#8211; loaded with arms shipments for Israel. The cargo ship&#8217;s destination is the port of Ashdod in Israel &#8211; a city only 25 km away from Gaza, where the world community has been observing genocide and the most serious war crimes against the Palestinian people for 7 months. It is up to all of us, and now especially the Spanish government, to actively do something about this!<\/p>\n\n\n\n<p>Today, the port of Cartagena awaits the arrival of the cargo ship Borkum. According to the identification codes of the individual containers, which are indicated in the documents received from the Campaign to Stop the Arms Trade with Israel, this ship contains: 20 tons of rocket engines (UN code class 1.3C 186), 12.5 tons of rockets with explosive charges (code 181), 1,500 kg of explosive materials (477) and 740 kg of cargoes, propellant charges for cannons (242).<\/p>\n\n\n\n<p>As lawyers, we would like to point out that we are not only subject to our conscience, but also to the law. The Arms Trade Treaty is clearly your responsibility as a signatory:<\/p>\n\n\n\n<p>The Arms Trade Treaty clearly states in its Article 6 that:<br><br>\u201cA State Party shall not authorize a transfer of conventional arms covered by Article 2(1) or of items covered by Article 3 or Article 4 if, at the time of authorization, it has knowledge that the arms or items would be used in the commission of genocide, crimes against humanity, grave breaches of the 1949 Geneva Conventions, attacks against civilian objects or civilians protected as such, or other war crimes as defined in international agreements to which it is a party.\u201d<\/p>\n\n\n\n<p>The same treaty (Article 2) states <strong>that the transfer of arms includes the export, import, transit, transshipment and brokering of arms<\/strong>. Authorizing a ship loaded with arms destined for Israel means allowing the transit of arms to a country currently under investigation for genocide against the Palestinian people and responsible for serious human rights violations. To date, it is estimated that over 35,000 people, including more than 15,000 children, have been killed. The port of Ashdod is barely 30 km from Gaza, and the company involved in the transfer, according to the documents, is IMI Systems, part of Elbit Systems, Israel&#8217;s largest arms company, which has a very close and highly strategic relationship with the Israeli Defense Forces. The documents state that \u201cunder no circumstances\u201d should the name IMI Systems and Israel appear on the Internet.<\/p>\n\n\n\n<p>We know that the Spanish government is committed to defending the rights of the Palestinian people. On such a symbolic day as today, when we commemorate 76 years of the Nakba, we ask you to check the contents of the freighter Borkum and prevent the military cargo it is carrying from reaching Israel to be used against the Palestinian people in Gaza, and to deny the ship further passage.<br><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Llamamiento al gobierno espa\u00f1ol<\/h2>\n\n\n\n<p>Somos un colectivo de abogados en Alemania. Hace unas semanas, hemos presentado <a href=\"https:\/\/donorbox.org\/no-weapons-for-genocide-support-our-new-legal-battle-against-germany-s-arms-exports-to-israel\" data-type=\"link\" data-id=\"https:\/\/donorbox.org\/no-weapons-for-genocide-support-our-new-legal-battle-against-germany-s-arms-exports-to-israel\" target=\"_blank\" rel=\"noopener\">un recurso urgente contra el env\u00edo de armas de Alemania a Israel<\/a> ante el Tribunal Administrativo de Berl\u00edn.<\/p>\n\n\n\n<p>Unos activistas nos han informado de que el carguero \u00abBorkum\u00bb atracar\u00e1 en Cartagena hoy, mi\u00e9rcoles, 15 de mayo de 2024, transportando un cargamento de armas para Israel. El buque de carga va con destino al puerto de Ashdod en Israel, una ciudad a tan solo 25 kil\u00f3metros de Gaza, donde la comunidad internacional lleva siendo testigo del genocidio y de algunos de los cr\u00edmenes de guerra m\u00e1s graves contra los palestinos durante los \u00faltimos 7 meses. Depende de todos nosotros, y ahora especialmente del gobierno espa\u00f1ol, \u00a1hacer algo al respecto!<\/p>\n\n\n\n<p>Hoy, el puerto de Cartagena espera la llegada del carguero Borkum. Seg\u00fan los c\u00f3digos de identificaci\u00f3n de los contenedores individuales, que se indican en los documentos recibidos de la Campa\u00f1a para Detener el Comercio de Armas con Israel, este buque contiene: 20 toneladas de motores de cohetes (c\u00f3digo ONU clase 1.3C 186), 12,5 toneladas de cohetes de carga explosiva (c\u00f3digo 181), 1.500 kg de materiales explosivos (477) y 740 kg de cargamentos, cargas propulsoras para ca\u00f1ones (242).<\/p>\n\n\n\n<p>Como abogados, nos gustar\u00eda se\u00f1alar que no s\u00f3lo estamos sujetos a nuestra conciencia, sino tambi\u00e9n a la ley. El Tratado sobre el Comercio de Armas es sin duda su responsabilidad como firmante:<\/p>\n\n\n\n<p>El Tratado sobre el Comercio de Armas establece claramente en el art\u00edculo 6 que:<br><br>\u00abUn Estado Parte no autorizar\u00e1 una transferencia de armas convencionales comprendidas en el apartado 1 del art\u00edculo 2 o de art\u00edculos comprendidos en los art\u00edculos 3 o 4 si, en el momento de la autorizaci\u00f3n, tiene conocimiento de que las armas o los art\u00edculos se utilizar\u00edan para cometer genocidio, cr\u00edmenes de lesa humanidad, violaciones graves de los Convenios de Ginebra de 1949, ataques contra objetivos civiles o contra civiles protegidos como tales, u otros cr\u00edmenes de guerra definidos en acuerdos internacionales de los que sea parte.\u00bb <\/p>\n\n\n\n<p>El mismo tratado (art\u00edculo 2) establece que la&nbsp;<strong>transferencia de armas incluye la exportaci\u00f3n, la importaci\u00f3n, el tr\u00e1nsito, el transbordo y el corretaje de armas<\/strong>. Autorizar un barco cargado de armas con destino a Israel significa permitir el tr\u00e1nsito de armas hacia un pa\u00eds actualmente investigado por genocidio contra el pueblo palestino y responsable de graves violaciones de los derechos humanos. A d\u00eda de hoy, se calcula que han muerto m\u00e1s de 35.000 personas, entre ellas m\u00e1s de 15.000 ni\u00f1os. El puerto de Ashdod est\u00e1 a apenas 30 kil\u00f3metros de Gaza y la empresa implicada en la transferencia, seg\u00fan los documentos, es IMI Systems, parte de Elbit Systems, la mayor empresa armament\u00edstica de Israel, que mantiene una relaci\u00f3n muy estrecha y altamente estrat\u00e9gica con las Fuerzas de Defensa israel\u00edes. Los documentos establecen que \u00abbajo ninguna circunstancia\u00bb el nombre de IMI Systems e Israel debe aparecer en Internet.<\/p>\n\n\n\n<p>Sabemos que el gobierno espa\u00f1ol est\u00e1 comprometido con la defensa de los derechos del pueblo palestino. En un d\u00eda tan simb\u00f3lico como hoy, en el que conmemoramos los 76 a\u00f1os de la Nakba, le pedimos al gobierno que compruebe el contenido del carguero Borkum, que impida que la carga militar que transporta llegue a Israel para ser utilizada contra el pueblo palestino en la Franja de Gaza y que niegue el paso al buque.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Appell an die Spanische Regierung<\/h2>\n\n\n\n<p>Wir sind ein Kollektiv an Rechtsanw\u00e4ltinnen und Rechtsanw\u00e4lten in Deutschland, die k\u00fcrzlich einen <a href=\"https:\/\/donorbox.org\/no-weapons-for-genocide-support-our-new-legal-battle-against-germany-s-arms-exports-to-israel\" data-type=\"link\" data-id=\"https:\/\/donorbox.org\/no-weapons-for-genocide-support-our-new-legal-battle-against-germany-s-arms-exports-to-israel\" target=\"_blank\" rel=\"noopener\">Eilantrag gegen die Waffenlieferungen von Deutschland nach Israel <\/a>vor dem Berliner Verwaltungsgericht angestrengt haben.<\/p>\n\n\n\n<p>Wir wurden von Aktivist*innen informiert, dass das Frachtschiff \u201eBorkum\u201c heute &#8211; Mittwoch, 15.5.2024- in Cartagena angelegt wird, beladen mit Waffenlieferungen f\u00fcr Israel. Ziel des Frachtschiffes ist der Hafen in Ashdod in Israel &#8211; eine Stadt nur 25 km entfernt von Gaza, wo die Weltgemeinschaft seit 7 Monaten einen Genozid und schwerste Kriegsverbrechen gegen die Pal\u00e4stinenser*innen beobachten muss. Es ist an uns alle, und nun ganz besonders an der Spanischen Regierung, hiergegen aktiv etwas zu unternehmen!<\/p>\n\n\n\n<p>Heute erwartet der Hafen von Cartagena die Ankunft des Frachtschiffes Borkum. Nach den Identifizierungscodes der einzelnen Container, die in den von der Kampagne zur Beendigung des Waffenhandels mit Israel erhaltenen Unterlagen angegeben sind, enth\u00e4lt dieses Schiff: 20 Tonnen Raketentriebwerke (UN-Codeklasse 1.3C 186), 12,5 Tonnen Raketen mit Sprengladungen (Code 181), 1.500 kg explosive Stoffe (477) und 740 kg Ladungen, Treibladungen f\u00fcr Kanonen (242).<\/p>\n\n\n\n<p>Als Rechtsanw\u00e4ltinnen und Rechtsanw\u00e4lte weisen wir Sie darauf hin, dass wir nicht nur unserem Gewissen unterworfen sind, sondern auch dem Gesetz. Das Arms Trade Treaty ist klar in der Verantwortung, die Sie als Vertragsunterzeichnerin trifft:<\/p>\n\n\n\n<p>Der Vertrag \u00fcber den Waffenhandel legt in seinem Artikel 6 klar fest, dass:<br><br>\u201eEin Vertragsstaat darf einen Transfer von konventionellen Waffen, die unter Artikel 2 Absatz 1 fallen, oder von Gegenst\u00e4nden, die unter Artikel 3 oder Artikel 4 fallen, nicht genehmigen, wenn er zum Zeitpunkt der Genehmigung Kenntnis davon hat, dass die Waffen oder Gegenst\u00e4nde zur Begehung von V\u00f6lkermord, Verbrechen gegen die Menschlichkeit, schweren Verst\u00f6\u00dfen gegen die Genfer Abkommen von 1949, Angriffen auf zivile Objekte oder Zivilpersonen, die als solche gesch\u00fctzt sind, oder anderen Kriegsverbrechen im Sinne internationaler \u00dcbereink\u00fcnfte, bei denen er Vertragspartei ist, verwendet werden w\u00fcrden.\u201c<\/p>\n\n\n\n<p>In demselben Vertrag (Artikel 2) hei\u00dft es, <strong>dass die Weitergabe von Waffen die Ausfuhr, die Einfuhr, die Durchfuhr, die Umladung und die Vermittlung von Waffen umfasst<\/strong>. Die Genehmigung f\u00fcr ein mit Waffen beladenes Schiff, das f\u00fcr Israel bestimmt ist, bedeutet, dass die Durchfuhr von Waffen in ein Land erlaubt wird, gegen das derzeit wegen V\u00f6lkermordes am pal\u00e4stinensischen Volk ermittelt wird und das f\u00fcr schwere Menschenrechtsverletzungen verantwortlich ist. Bis heute wurden sch\u00e4tzungsweise \u00fcber 35.000 Menschen, darunter mehr als 15.000 Kinder, get\u00f6tet. Der Hafen von Aschdod ist kaum 30 km vom Gazastreifen entfernt, und das an dem Transfer beteiligte Unternehmen ist den Unterlagen zufolge IMI Systems, das zu Elbit Systems geh\u00f6rt, Israels gr\u00f6\u00dftem Waffenkonzern, der eine sehr enge und \u00e4u\u00dferst strategische Beziehung zu den israelischen Streitkr\u00e4ften unterh\u00e4lt. In den Unterlagen hei\u00dft es, dass \u201eunter keinen Umst\u00e4nden\u201c der Name IMI Systems und Israel im Internet auftauchen d\u00fcrfe.<\/p>\n\n\n\n<p>Wir wissen, dass sich die spanische Regierung f\u00fcr die Verteidigung der Rechte des pal\u00e4stinensischen Volkes einsetzt.
