{"id":3213,"date":"2024-03-20T12:23:58","date_gmt":"2024-03-20T11:23:58","guid":{"rendered":"https:\/\/cms.elsc.support\/?p=3213"},"modified":"2025-04-14T12:47:45","modified_gmt":"2025-04-14T10:47:45","slug":"winter-updates-recent-victories-for-the-defence-of-palestinian-rights-advocacy-in-europe","status":"publish","type":"post","link":"https:\/\/elsc.support\/de\/winter-updates-recent-victories-for-the-defence-of-palestinian-rights-advocacy-in-europe\/","title":{"rendered":"ELSC Newsletter: Spring 2024"},"content":{"rendered":"<p>Dear Friend,\u202f\u202f&nbsp;<\/p>\n\n\n\n<p>In the past weeks and months, we have joined forces with many of you who are mobilising tirelessly for an end to Israel\u2019s heinous crimes against Gaza.&nbsp;<strong>In the first 2 months of 2024 alone<\/strong>, we&#8217;ve fought some crucial battles and secured a number of&nbsp;victories for the movement \u2013 which we bring to you in this month&#8217;s newsletter. \u202f&nbsp;<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading alignwide has-text-align-center\"><strong>JUSTICE &amp; ACCOUNTABILITY\u202f<\/strong><\/h2>\n\n\n\n<p><strong>Accountability Now: Palestinians Sue German Government Officials for Enabling the Genocide in Gaza\u202f&nbsp;<\/strong><\/p>\n\n\n\n<p>Last month, we supported a group of German lawyers \u2013 representing families of two Gazans \u2013 who&nbsp;<a href=\"https:\/\/elsc.support\/de\/news\/accountability-now-palestinians-sue-german-government-officials-for-enabling-the-genocide-in-gaza\/\" rel=\"noreferrer noopener\" target=\"_blank\">filed a criminal complaint<\/a>&nbsp;against German Government officials, including Chancellor Olaf Scholz, for the crime aiding and abetting genocide against the Palestinian people in Gaza by providing Israel with weapons and other material support. Democracy for Germany!\u202f&nbsp;<\/strong><\/p>\n\n\n\n<p>\u202fWe have joined forces with activist groups and organisations coming together in the&nbsp;<strong>Kufiya Network<\/strong>&nbsp;in a collective call against the repression of the Palestine solidarity movement in Germany. Together, we reject the construction of a \u2018reason of state\u2019 that forces on us \u2018an unconditional solidarity\u2019 with war crimes, and the criminalisation of any resistance to the occupation.\u202f&nbsp;<\/p>\n\n\n\n<div class=\"wp-block-buttons is-content-justification-center is-layout-flex wp-container-core-buttons-is-layout-16018d1d wp-block-buttons-is-layout-flex\">\n<div class=\"wp-block-button is-style-fill\"><a class=\"wp-block-button__link has-text-align-center wp-element-button\" href=\"https:\/\/kufiyanetzwerk.noblogs.org\/post\/2023\/12\/05\/en\/\" target=\"_blank\" rel=\"noopener\"><strong>READ THE STATEMENT HERE<\/strong><\/a><\/div>\n<\/div>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p><strong>Accountability for EU Complicity with Israeli Illegal Settlements: A New Legal Victory Highlights the EU Commission\u2019s Shortcomings\u202f&nbsp;<\/strong><\/p>\n\n\n\n<p>After discovering that the European Commission (EC)&nbsp;<a href=\"https:\/\/www.eccpalestine.org\/eu-funded-helsinki-university-hospital-project-connected-to-israels-illegal-settlement\/\" target=\"_blank\" rel=\"noreferrer noopener\">was violating its own rules<\/a>&nbsp;around the funding of projects involving Israeli entities, an activist with ICAHD Finland, with the support of the ELSC, recently got the EU Ombudsman to issue an important decision which confirmed that any entity established in the Israeli illegal settlements in the OPT should be excluded from EU cooperation projects. They reached out to the ELSC and we connected them with lawyers on the ground who helped them take legal action against the Science Secretary for her unfounded and outrageous allegations. UKRI has now concluded they were not in breach of the terms of their appointment.\u202f<\/p>\n\n\n\n<div class=\"wp-block-buttons is-content-justification-center is-layout-flex wp-container-core-buttons-is-layout-16018d1d wp-block-buttons-is-layout-flex\">\n<div class=\"wp-block-button is-style-fill\"><a class=\"wp-block-button__link has-text-align-center wp-element-button\" href=\"https:\/\/twitter.com\/elsclegal\/status\/1765688276269064459\" target=\"_blank\" rel=\"noopener\"><strong>READ MORE &amp; AMPLIFY<\/strong><\/a><\/div>\n<\/div>\n\n\n\n<p>These are not isolated attacks.\u202f\u202f&nbsp;<\/p>\n\n\n\n<p><strong>Jewish Chronicle is once again forced to apologise to Palestinian scholar Nimer Sultany for publicly smearing him!<\/strong>&nbsp;Dr Sultany&#8217;s&nbsp;<a href=\"https:\/\/twitter.com\/NimerSultany\/status\/1737451640607715626\" target=\"_blank\" rel=\"noreferrer noopener\">emblematic victory&nbsp;<\/a>back in December 2023 continues to expose the ongoing pattern of character assassinations aimed at silencing Palestinian and allied voices. For more see: http:\/\/mattchun.com.<\/figcaption><\/figure>\n\n\n\n<p>But on 30 January 2024, a High Court judge publicly \u201crebuked\u201d the Home Secretary\u2019s&nbsp;<a href=\"https:\/\/www.theguardian.com\/politics\/2024\/feb\/13\/judge-criticises-home-office-errors-in-palestinian-refugees-visa-case?CMP=Share_iOSApp_Other\" target=\"_blank\" rel=\"noreferrer noopener\">&#8216;grave&#8217; and &#8216;shockingly poor&#8217; conduct<\/a>&nbsp;in handling the visa challenge of Amena. One of them, a Palestinian woman,\u202fwas arrested for criticising the police as they tried to take away her megaphone. The other activist was stopped when\u202fshouting &#8220;Free Palestine&#8221; as she walked through the station.<strong>&nbsp;By challenging their charges, we send a message to The Hague&#8217;s police department that they cannot interfere with our right to speak up and protest genocide!\u202f<\/strong><\/p>\n\n\n\n<div class=\"wp-block-buttons is-content-justification-center is-layout-flex wp-container-core-buttons-is-layout-16018d1d wp-block-buttons-is-layout-flex\">\n<div class=\"wp-block-button is-style-fill\"><a class=\"wp-block-button__link has-text-align-center wp-element-button\"><strong>DONATE HERE<\/strong><\/a><\/div>\n<\/div>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p><strong>NGO worker is challenging his unfair dismissal after denouncing ethnic cleansing on X!<\/strong>&nbsp;After speaking out via a X (formerly Twitter) on his personal capacity, posting in support of Palestinians in Gaza during the first days of Israel&#8217;s genocidal campaign, Ousman Noor&#8217;s employment contract was terminated. The reasons for dismissal were never clarified. Ousman has now filed a lawsuit against his former employer.&nbsp;<a href=\"https:\/\/twitter.com\/ousmannoor\/status\/1767178546928087306\" target=\"_blank\" rel=\"noreferrer noopener\">Share his call.<\/a>&nbsp;Ousman is almost there with crowdfunding the necessary funds to cover his legal fees but needs a last little push.<strong>&nbsp;If you want to help him,&nbsp;<a href=\"https:\/\/twitter.com\/ousmannoor\/status\/1767178546928087306\" target=\"_blank\" rel=\"noreferrer noopener\">donate here<\/a>&nbsp;&#8211; the crowdfunding expires on 18 March!\u202f&nbsp;<\/strong><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading alignwide has-text-align-center\"><strong>MORE VICTORIES FOR OUR MOVEMENT\u202f&nbsp;<\/strong><\/h2>\n\n\n\n<p><strong>Our rallying cry \u201cfrom the river to the sea, Palestine will be free!\u201d is once again unable to be suppressed!<\/strong>&nbsp;In Prague, activists won another legal battle against the attempts to censor \u201cfrom the river to the sea, Palestine will be free\u201d (see&nbsp;<a href=\"https:\/\/twitter.com\/elsclegal\/status\/1741430464852664416\" target=\"_blank\" rel=\"noreferrer noopener\">here<\/a>&nbsp;about attempts in Germany and recent victories). In December 2023, the City of Prague banned a demonstration because the slogan would be used, but activists pushed back and went to court. This is a big win for the tireless advocacy of organisations like The Rights Forum, PAX for peace, and Oxfam!\u00a0<a href=\"https:\/\/twitter.com\/elsclegal\/status\/1757102284167631067\" target=\"_blank\" rel=\"noreferrer noopener\">The court ruled that<\/a>\u00a0the State should have revoked the export license in light of Israel\u2019s violations of basic principles of humanitarian law in its assault on Gaza. It builds on a comprehensive glossary of terms, definitions and concrete examples, as well as a developed methodology for analysis to expose patterns and scandalise anti-Palestinian racism, colonial narratives, and Zionist disinformation. University of Milan\u202f&nbsp;<\/strong><\/p>\n\n\n\n<p>We have participated in a seminar organised by the University of Milan on the 5th of March, where we presented our legal work within the wider context of the Palestine solidarity movement and the growing repression across Europe post 7 October.\u202f\u202f&nbsp;<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p><strong>Palestine solidarity events \u2013 Online\u202f\u202f&nbsp;<\/strong><\/p>\n\n\n\n<p>In the past months, we have participated in a number of solidarity events with Palestine organised across Europe, in which we have spoken about&nbsp;<a href=\"https:\/\/twitter.com\/ousmannoor\/status\/1755216478062641191\" target=\"_blank\" rel=\"noreferrer noopener\">countering discrimination and intimidation<\/a>, international solidarity and&nbsp;<a href=\"https:\/\/www.instagram.com\/p\/CzoC6RXsdQJ\/?img_index=1\" target=\"_blank\" rel=\"noreferrer noopener\">activism for a ceasefire<\/a>,&nbsp;<a href=\"https:\/\/www.instagram.com\/p\/CzoC6RXsdQJ\/?img_index=1\" target=\"_blank\" rel=\"noreferrer noopener\">censorship in Germany<\/a>&nbsp;or&nbsp;<a href=\"https:\/\/twitter.com\/centre_IRIDIA\/status\/1752388807003955614\" target=\"_blank\" rel=\"noreferrer noopener\">legal responses to the colonial assault<\/a>&nbsp;on Gaza with Catalan organisations, including the Centre for the Defence of Human Rights IR\u00cdDIA.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading alignwide has-text-align-center\"><strong>ELSC IN THE MEDIA<\/strong><\/h2>\n\n\n\n<p><strong>No country for Palestinians: a chronicle of suppression and resistance in Germany\u202f&nbsp;<\/strong><\/p>\n\n\n\n<p>German state and police response to Palestinian solidarity protests since 7 October, especially in the first weeks, has been unabashedly severe.&nbsp;<strong>From 11 to 20 October alone, we counted 600 detentions in Berlin,&nbsp;<\/strong>including of minors among those showing solidarity with Palestine, alongside a series of criminal and administrative proceedings.\u202f\u202f&nbsp;<\/p>\n\n\n\n<p>The historical and systematic censorship of Palestinian narratives and lived realities is often framed in the language of individual and isolated cases.&nbsp;<strong>In collaboration with our Monitor Project, Untold Stories Media has visualised our data<\/strong>&nbsp;to shed light on colonial and orientalist roots of anti-Palestinian repression in Germany, and (hi)stories of Palestinian resistance and steadfast defiance.
