She is a German Palestinian academic who has been subjected to several disinformation campaigns and surveilled. In 2019, she discovered that a secret dossier circulated about her, distorting her academic work and other data to frame her as anti-Jewish racist, sexist and as a terrorist sympathizer. After two long years of proceedings with the Berlin Data Protection Authority that failed to issue a final decision on her case, Dr. Younes is now filing two lawsuits to seek justice.<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<iframe loading=\"lazy\" title=\"Censored and Surveilled: Repression of German-Palestinian Academic\" width=\"720\" height=\"405\" src=\"https:\/\/www.youtube.com\/embed\/mH6MmpPmmzo?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/div><\/figure>\n\n\n\n<p>This case illustrates the increasing violation of democratic principles with respect to Palestinian rights advocates across Europe and Germany in particular. In two different episodes, the City of Stuttgart withdrew the Committee\u2019s access to the City\u2019s website to advertise their activities, and the Landesbank Baden-W\u00fcrttemberg Bank announced the termnation of their bank accounts. Both decisions where based on the German Parliament\u2019s anti-BDS resolution (among other reasons).<\/p>\n\n\n\n<p>The activists legally challenged those undemocratic decisions and the Courts gave them reason. The Administrative Court and the Regional Court of Stuttgart both held that the Bundestag\u2019s anti-BDS resolution lacks any legal binding effect. The Administrative Court\u00a0<a href=\"https:\/\/support.us20.list-manage.com\/track\/click?u=0de9e0231539d1a4c5b3272e5&amp;id=78465c945a&amp;e=63873cc3c9\" target=\"_blank\" rel=\"noopener\">reaffirmed<\/a>\u00a0that the BDS movement does not incite hatred against the Jewish people, and that it must be protected from undue interference.<\/p>\n\n\n\n<h3 class=\"has-text-align-center wp-block-heading\"><a rel=\"noreferrer noopener\" href=\"https:\/\/support.us20.list-manage.com\/track\/click?u=0de9e0231539d1a4c5b3272e5&amp;id=56e01a2529&amp;e=63873cc3c9\" target=\"_blank\">SHARE THIS VICTORY<\/a><\/h3>\n\n\n\n<p>These decisions are consistent with a growing trend in German case law, which upholds the legitimacy of BDS.\u00a0<a href=\"https:\/\/support.us20.list-manage.com\/track\/click?u=0de9e0231539d1a4c5b3272e5&amp;id=71fd71a284&amp;e=63873cc3c9\" target=\"_blank\" rel=\"noopener\">Read our analysis<\/a>. Ahmed Abed, the lawyer who defended the Stuttgart activists, is also\u00a0<a rel=\"noreferrer noopener\" href=\"https:\/\/support.us20.list-manage.com\/track\/click?u=0de9e0231539d1a4c5b3272e5&amp;id=750b91828a&amp;e=63873cc3c9\" target=\"_blank\">challenging the German Bundestag\u2019s anti-BDS resolution<\/a>\u00a0with the Palestinian-Jewish-German team of activists BT3P.<\/p>\n\n\n\n<h3 class=\"has-text-align-center wp-block-heading\"><a rel=\"noreferrer noopener\" href=\"https:\/\/support.us20.list-manage.com\/track\/click?u=0de9e0231539d1a4c5b3272e5&amp;id=6204121984&amp;e=63873cc3c9\" target=\"_blank\">SUPPORT THE CASE<\/a><\/h3>\n\n\n\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<h2 class=\"has-text-align-left wp-block-heading\"><strong>A HIGHLY CONTESTABLE JUDGEMENT AGAINST BDS AUSTRIA<\/strong><\/h2>\n\n\n\n<p>In a decision delivered on 6 April 2022, the Commercial Court of Vienna endorsed the City of Vienna\u2019s lawsuit, ruling against the BDS activists.<\/p>\n\n\n\n<h3 class=\"has-text-align-center wp-block-heading\"><a rel=\"noreferrer noopener\" href=\"https:\/\/support.us20.list-manage.com\/track\/click?u=0de9e0231539d1a4c5b3272e5&amp;id=e0384644ec&amp;e=63873cc3c9\" target=\"_blank\">TAKE ACTION<\/a><\/h3>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter size-large is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/cms.elsc.support\/wp-content\/uploads\/2022\/05\/signal-2022-01-28-135709_002-1024x768.jpeg\" alt=\"\" class=\"wp-image-1986\" width=\"531\" height=\"398\" srcset=\"https:\/\/elsc.support\/wp-content\/uploads\/2022\/05\/signal-2022-01-28-135709_002-1024x768.jpeg 1024w, https:\/\/elsc.support\/wp-content\/uploads\/2022\/05\/signal-2022-01-28-135709_002-300x225.jpeg 300w, https:\/\/elsc.support\/wp-content\/uploads\/2022\/05\/signal-2022-01-28-135709_002-768x576.jpeg 768w, https:\/\/elsc.support\/wp-content\/uploads\/2022\/05\/signal-2022-01-28-135709_002-1536x1152.jpeg 1536w, https:\/\/elsc.support\/wp-content\/uploads\/2022\/05\/signal-2022-01-28-135709_002-1200x900.jpeg 1200w, https:\/\/elsc.support\/wp-content\/uploads\/2022\/05\/signal-2022-01-28-135709_002.jpeg 1600w\" sizes=\"auto, (max-width: 531px) 100vw, 531px\" \/><\/figure><\/div>\n\n\n\n<p>The Court\u2019s decision is deeply problematic as it ignores the evidence submitted on behalf of the BDS activist, including legal opinions of renowned international and Israeli scholars. In 2019, she discovered that a secret dossier circulated about her, distorting her academic work and other data to frame her as anti-Jewish racist, sexist and as a terrorist sympathizer.
