Victory in Court: Berlin Nakba demonstration restriction revoked after ELSC legal intervention  

Berlin, 15th May 2025 – An urgent appeal filed by the European Legal Support Center has successfully overturned restrictions on this year ‘s Nakba demonstration in Berlin. The Berlin administrative court ruled against the Berlin assembly authority ‘s attempt to limit the demonstration to a stationary rally. As a result, the demonstration will now be permitted to march as originally planned. 

The court decided that restricting the demonstration to a stationary rally is unlawful. In our successful appeal, the ELSC had argued the restriction was a violation of freedom of expression and assembly, rights protected under Articles 5 and 8 of the German Basic Law, which the court affirmed.

In its decision, the court highlighted that the Berlin assembly authority’s reasoning for a restriction to a stationary rally was inconsistent and therefore dismissible.  

ELSC Lawyer Alexander Gorski comments: 
“We filed the urgent appeal knowing the restriction was imposed out of anti-Palestinian motivations. The court now confirmed that Berlin’s assembly authority had no valid reason at all for the restriction. The demonstration will march today, and the people of Berlin will protest the ongoing Genocide in Palestine.” 

The police authorities may file an appeal to the Higher Administrative Court (Oberverwaltungsgericht Berlin-Brandenburg). 


The ELSC is closely monitoring the situation and preparing for all scenarios.
