{"id":4881,"date":"2024-10-30T08:13:34","date_gmt":"2024-10-30T07:13:34","guid":{"rendered":"\/?p=3888"},"modified":"2025-04-14T12:40:31","modified_gmt":"2025-04-14T10:40:31","slug":"emergency-motion-against-the-delivery-of-explosives-from-the-german-ship-mv-kathrin-to-israel","status":"publish","type":"post","link":"https:\/\/elsc.support\/ar\/emergency-motion-against-the-delivery-of-explosives-from-the-german-ship-mv-kathrin-to-israel\/","title":{"rendered":"Emergency motion against the delivery of explosives carried by the German ship MV Kathrin to Israel\u00a0"},"content":{"rendered":"<p>Berlin, 29 October 2024 \u2013 The European Legal Support Center (ELSC) has filed an emergency motion with the Berlin Administrative Court (Verwaltungsgericht Berlin), requesting that the court mandate the German government to stop the delivery of military RDX explosives to Israel, which are currently being transported on the German cargo ship MV Kathrin. Berlin-based lawyer Ahmed Abed, part of the ELSC\u2019s network of lawyers in Germany, filed the urgent appeal on behalf of three Palestinians in Gaza, asking the German government to protect their right to life.&nbsp;<\/p>\n\n\n\n<p>The MV Kathrin is carrying 150,000 kg (8 shipping containers) of RDX explosives bound for Israeli Military Industries, the munitions production arm of Israel&#8217;s largest military company Elbit Systems. Elbit Systems uses the RDX explosive to manufacture weapons of war such as aerial bombs, mortars and rockets, which are used in violation of international law to commit crimes against humanity, genocide and war crimes in the Gaza Strip. The petitioners demand that the delivery be stopped and that action be taken against the owner and the manager of the ship.&nbsp;<\/p>\n\n\n\n<p>On 23 August 2024, Namibian authorities found evidence of the military cargo on the MV Kathrin and prohibited the ship from docking, highlighting the <a href=\"https:\/\/gpil.jura.uni-bonn.de\/2024\/08\/namibia-denies-port-access-to-german-owned-vessel-carrying-military-equipment-to-israel\/\" target=\"_blank\" rel=\"noreferrer noopener\">urgency<\/a> to \u2018comply with its obligation not to assist or become complicit in Israeli war crimes, crimes against humanity, genocide, and the unlawful occupation of Palestine\u2019. Since then, the ELSC has worked closely with the global BDS movement and various legal experts to alert state authorities to their obligations not to participate in the supply of weapons that facilitate Israeli violations of international law, and to stop the shipment. The UN Special Rapporteur on the Occupied Palestinian Territories, <a href=\"https:\/\/x.com\/FranceskAlbs\/status\/1843228884180897853\" target=\"_blank\" rel=\"noreferrer noopener\">Francesca Albanese<\/a>, and <a href=\"https:\/\/www.amnesty.org\/en\/latest\/news\/2024\/10\/israel-opt-slovenia-montenegro-and-portugal-must-not-assist-the-mv-kathrins-delivery-of-explosives-to-israel\/\" target=\"_blank\" rel=\"noreferrer noopener\">Amnesty International<\/a> have called for the MV Kathrin&#8217;s shipment of RDX explosives to be stopped, underlining obligations under the Genocide Convention and the Arms Trade Treaty (ATT).&nbsp;<\/p>\n\n\n\n<p>The MS Kathrin was unable to call at any ports in Africa and the Mediterranean, although attempts were made in at least Angola, Slovenia, Montenegro and Malta. In mid-October 2024, the Portuguese government demanded the removal of the Portuguese flag from the ship.&nbsp;<\/p>\n\n\n\n<p>Since then, the MV Kathrin has been sailing under the German flag. As of October 24, 2024, shortly after departing from a port area outside Malta&#8217;s territorial waters, the MV Kathrin has been operating in stealth mode, deactivating all GPS satellite signals. The ship was sighted by journalists in the Albanian port of Porto Romano on Thursday evening, where it was unloaded, with the exception of ten containers, possibly including the eight containers of RDX intended for the Israeli genocide. The ship has subsequently departed from the port.&nbsp;<\/p>\n\n\n\n<p>Ahmed Abed explains:&nbsp;<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u2018Germany is obliged to take action against the German freighter MV Kathrin because the Genocide Convention and international humanitarian law require active intervention. The ICJ and the Chief Investigator of the International Criminal Court, Karim Khan, have provided detailed evidence that Israel is committing not only systematic war crimes but also crimes against humanity in the Gaza Strip.\u2019&nbsp;<\/p>\n<\/blockquote>\n\n\n\n<p>According to an open letter from American doctors, Israel\u2019s military operation has killed at least 119,000 people since October 2023; approximately 5.4% of the 2.1 million population of the Gaza Strip. The danger of genocide has already been clearly exceeded. &nbsp;On 26 February 2024, a Dutch court of appeal had also ruled that the delivery of F-35 spare parts to Israel must be stopped. KG.&nbsp;<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"has-larger-font-size\"><strong>Dringlichkeitsantrag gegen die Lieferung von Sprengstoff vom deutschen Schiff MV Kathrin nach Israel<\/strong>\u00a0<\/p>\n\n\n\n<p>Oktober 2024 &#8211; Das European Legal Support Center (ELSC) hat heute einen Eilantrag beim Verwaltungsgericht Berlin eingereicht, in dem das Gericht die Bundesregierung auffordert, die Lieferung von milit\u00e4rischem RDX-Sprengstoff nach Israel zu stoppen, der sich derzeit an Bord des deutschen Frachtschiffs MV Kathrin befindet. Der Berliner Anwalt Ahmed Abed reichte den Eilantrag im Namen von drei Pal\u00e4stinenser*innen in Gaza ein, die von der deutschen Regierung verlangen, ihr Recht auf Leben zu sch\u00fctzen.&nbsp;<\/p>\n\n\n\n<p>Die MV Kathrin hat 150.000 kg (8 Schiffscontainer) RDX-Sprengstoff an Bord, der an Israeli Military Industries, der Munitionsproduktion von Israels gr\u00f6\u00dftem Milit\u00e4runternehmen Elbit Systems, nach Israel geliefert werden soll. Elbit Systems verwendet den RDX-Sprengstoff zur Herstellung von Kriegswaffen wie Fliegerbomben, M\u00f6rsern und Raketen, die f\u00fcr Verst\u00f6\u00dfe gegen das V\u00f6lkerrecht wie Verbrechen gegen die Menschlichkeit, V\u00f6lkermord und Kriegsverbrechen im Gazastreifen eingesetzt werden. Die Antragstellenden fordern, dass die Lieferung gestoppt und Ma\u00dfnahmen gegen den Eigent\u00fcmer und den Manager des Schiffes ergriffen werden.&nbsp;<\/p>\n\n\n\n<p>Am 23. August 2024 fanden die <a href=\"https:\/\/namibischen\/\" target=\"_blank\" rel=\"noreferrer noopener\">namibischen<\/a> Beh\u00f6rden Beweise f\u00fcr die milit\u00e4rische Fracht auf der MV Kathrin und untersagten das Anlegen des Schiffes, um ihrer \u201eVerpflichtung nachzukommen, israelische Kriegsverbrechen, Verbrechen gegen die Menschlichkeit, V\u00f6lkermord sowie die unrechtm\u00e4\u00dfige Besetzung Pal\u00e4stinas nicht zu unterst\u00fctzen oder sich daran zu beteiligen\u201c. Seitdem arbeitet das ELSC mit der weltweiten BDS-Bewegung und diversen Rechtsexperten zusammen, um die staatlichen Beh\u00f6rden auf ihre Verpflichtungen hinzuweisen, sich nicht mit der Lieferung von Waffen an israelische V\u00f6lkerrechtsverst\u00f6\u00dfe zu beteiligen und die Ladung zu stoppen. Die UN-Sonderberichterstatterin f\u00fcr die besetzten pal\u00e4stinensischen Gebiete<a href=\"https:\/\/x.com\/FranceskAlbs\/status\/1843228884180897853\" target=\"_blank\" rel=\"noreferrer noopener\">, Francesca Albanese<\/a>, sowie <a href=\"https:\/\/www.amnesty.org\/en\/latest\/news\/2024\/10\/israel-opt-slovenia-montenegro-and-portugal-must-not-assist-the-mv-kathrins-delivery-of-explosives-to-israel\/\" target=\"_blank\" rel=\"noreferrer noopener\">Amnesty International<\/a>, haben mit Blick auf die Verpflichtungen aus der V\u00f6lkermordkonvention und dem Vertrag \u00fcber den Waffenhandel (ATT) dazu aufgerufen, die Lieferung von RDX-Sprengstoff durch die MV Kathrin zu stoppen.\u202f&nbsp;<\/p>\n\n\n\n<p>Die MV Kathrin konnte keinen Hafen in Afrika und im Mittelmeerraum anlaufen, obwohl zumindest in Angola, Slowenien, Montenegro und Malta Versuche unternommen wurden.\u202f Die portugiesische Regierung zwang den Kapit\u00e4n des Schiffes Mitte Oktober 2024 die Flagge des Schiffes zu wechseln.\u202f&nbsp;<\/p>\n\n\n\n<p>Seitdem f\u00e4hrt die MV Kathrin unter deutscher Flagge. Seit dem 24. Oktober 2024, kurz nach dem Verlassen eines Hafengebiets au\u00dferhalb der Hoheitsgew\u00e4sser Maltas, f\u00e4hrt die MS Kathrin im Stealth-Modus und schaltet alle GPS-Satellitensignale ab. Das Schiff wurde am Donnerstagabend von Journalist:innen im albanischen Hafen von Porto Romano gesichtet, wo die MV Kathrin mit Ausnahme von zehn Containern entladen wurde, darunter m\u00f6glicherweise die acht Container mit RDX f\u00fcr den israelischen V\u00f6lkermord. Seit Freitag hat das Schiff den Hafen verlassen.&nbsp;<\/p>\n\n\n\n<p>Ahmed Abed erkl\u00e4rt:\u202f&nbsp;<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201eDeutschland ist verpflichtet, gegen den deutschen Frachter MV Kathrin einzuschreiten, weil die V\u00f6lkermordkonvention und das humanit\u00e4re V\u00f6lkerrecht ein aktives Eingreifen erfordern. Der IGH und der Chefermittler des Internationalen Strafgerichtshofs, Karim Khan, haben detailliert nachgewiesen, dass Israel im Gazastreifen nicht nur systematische Kriegsverbrechen, sondern auch Verbrechen gegen die Menschlichkeit begeht.\u201c&nbsp;<\/p>\n<\/blockquote>\n\n\n\n<p>Die israelische Milit\u00e4roperation seit Oktober 2023 hat laut einem offenen Brief amerikanischer \u00c4rzte zu mindestens 119.000 Ermordeten gef\u00fchrt, das sind 5,4% der 2,1 Millionen Bev\u00f6lkerung in Gaza. Die Gefahr eines V\u00f6lkermordes wurde bereits deutlich \u00fcberschritten. Ein niederl\u00e4ndisches Berufungsgericht hatte bereits am 26. Februar 2024 entschieden, dass die Lieferung von F-35-Ersatzteilen an Israel gestoppt werden muss, da Israel Kriegsverbrechen in Gaza ver\u00fcbt.
