{"id":4149,"date":"2025-02-24T15:55:11","date_gmt":"2025-02-24T14:55:11","guid":{"rendered":"\/?p=4149"},"modified":"2025-02-24T15:55:11","modified_gmt":"2025-02-24T14:55:11","slug":"vienna-administrative-court-declares-police-raid-of-palestine-solidarity-encampment-vienna-unconstitutional","status":"publish","type":"post","link":"https:\/\/elsc.support\/ar\/vienna-administrative-court-declares-police-raid-of-palestine-solidarity-encampment-vienna-unconstitutional\/","title":{"rendered":"Vienna Administrative Court Declares Police Raid of Palestine Solidarity Encampment Vienna Unconstitutional\u202f\u00a0"},"content":{"rendered":"\n<p>In November 2024, the Vienna Administrative Court ruled on a complaint against the Vienna Police concerning the dissolution of the Palestine Solidarity Encampment Vienna at the University of Vienna on 8 May 2024,<strong> and declared the measures taken by the police to be unlawful and unconstitutional.\u202f<\/strong>&nbsp;<\/p>\n\n\n\n<p>The Palestine Solidarity Encampment had been set up on the University of Vienna Campus for only three days when the Vienna Police special unit <em>Wiener Einsatzgruppe Alarmabteilung (WEGA)<\/em> stormed it in the middle of the night, \u200b\u200b\u200b\u200battacking students present at the camp. Around 200 armed police officers violently evicted students and activists using drones, surveillance vans, police dogs, lorries, and a crane. \u202f&nbsp;<\/p>\n\n\n\n<p>At the time of the raid, the police gave no\u200b clear\u200b indication or \u200bconsistent \u200blegal basis as to why the camp was being demolished. The Vienna Police Department later declared that after \u201ca final assessment by the Directorate of State Security and Intelligence Service (DSN) [&#8230;] the purpose of this gathering was no longer compatible with the Austrian legal situation after extensive consideration.\u201d According to the police department of Vienna \u201cthe prosecuting authority had to conclude that the true aim or purpose of the gathering [&#8230;]\u200b \u200bwas to show solidarity with the aims of HAMAS and to create a mental breeding ground for the approval of terrorist offences within the meaning of Section 282a (2) of the Criminal Code \u200b(\u200bStGB\u200b)\u200b [approval of terrorist offences].\u201d\u202f\u202f&nbsp;<\/p>\n\n\n\n<p>\u200b\u200b\u200b\u200b\u200b\u200b\u200bThe police substantiated these claims, citing that assembly participants had chanted the slogan &#8220;From the River to the Sea, Palestine will be free&#8221; and that the word \u201cIntifada\u2019\u2019 was displayed on banners.&nbsp;&nbsp;<\/p>\n\n\n\n<p><strong>No factual grounds<\/strong>&nbsp;<\/p>\n\n\n\n<p>The court dismissed these claims, reaffirming that freedom of assembly and freedom of expression are protected even when opinions expressed are considered shocking or offensive, as per settled case law of the European Court of Human Rights. Moreover, the court highlighted that expressing sympathy for a designated terrorist organisation, as has been claimed by the Vienna Police Department, would only constitute a crime under Section 282a StGB \u201cApproval of terrorist offences\u201d where it is likely to induce the commission of\u202factual terrorist offences. The court further acknowledged that the use of the expressions \u201cFrom the river to the sea, Palestine will be free\u201d and \u201cIntifada\u201d does not constitute an incitement to commit a terrorist offence or an identification with Hamas specifically, unless further expressions suggest the opposite.\u202fAccordingly, it cannot be concluded <em>a priori <\/em>that these slogans would create a \u201cmental breeding ground for the approval of terrorist crimes\u201d. Ultimately, there are no factual grounds that could explain the dissolution of the assembly.\u202f&nbsp;<\/p>\n\n\n\n<p><strong>The unlawful attack on the camp<\/strong>\u202f&nbsp;<\/p>\n\n\n\n<p>During the raid, four students refused to leave after the police stormed the camp to prevent eviction and protect it. Three were then physically removed from the camp, isolated, and detained. Another student resisted removal and potential arrest by climbing a nearby tree, remaining there for approximately eight hours. The students were denied legal assistance for hours, and only \u200btwo individuals were\u200b allowed to enter the premises \u200bfor merely a few minutes \u200bafter protesters loudly advocated for the students\u2019 legal rights.\u202f\u202f&nbsp;<\/p>\n\n\n\n<p>Meanwhile, hundreds of supporters spontaneously gathered outside the campus in solidarity, blocking trams and traffic at the intersection of Alser\u200b Stra\u00dfe\u200b\u200b \u200band Spitalgasse\u200b in the 9th district of Vienna\u200b. Police reportedly made racist remarks against the protestors, telling one demonstrator that they should \u201cgo back to where they came from\u201d after they requested an English translation of the police\u2019s instructions.\u202f\u202f&nbsp;<\/p>\n\n\n\n<p>\u200b\u200bStudents \u200band supporters \u200bo\u200butside the\u200b\u200b \u200bcampus continued to protest until the morning hours of May 9<sup>th<\/sup>, occupying the tram lines and disrupting business as usual. Early in the morning, they continued their protests all the way to the police detention centre (PAZ) at Ro\u00dfauer L\u00e4nde, where they demanded the release of the arrested activists and \u200bchanted \u200bagainst the destruction of the camp, with a line of police vans tailing them. Once they arrived at the PAZ, they faced a line of seven police vans. Within minutes of their arrival, around 30 people were aggressively surrounded by the police and were not allowed to leave. Police officers physically assaulted protesters and threatened to arrest them in a form of intimidation. Eventually, all protesters were forced to show identification, some were also forced to have their faces photographed. They were later notified by the police that criminal charges were being investigated.\u202f\u200b\u200b\u200b&nbsp;<\/p>\n\n\n\n<p>\u200b\u200b\u200bSome of the students saw it as a necessity not to let this happen without taking a stand and took this case to court to draw attention to the repression of the Palestine Solidarity Movemen\u200b\u200bt in Austria. \u200b\u200b&nbsp;<\/p>\n\n\n\n<p>\u200b\u200b\u200bELSC lawyer Kiran Chaudhuri said: \u201cWe welcome the ruling obtained by our partner lawyers in Austria as a legal victory against the increasingly authoritarian anti-Palestinian repression committed by European police authorities. The court made it abundantly clear that freedom of expression and assembly are constitutional rights which are not to be granted by the police but, rather, must be protected by the authorities. This ruling can serve as a legal precedent for similar unlawful police actions against the growing Palestine solidarity movement in Europe.\u201d\u202f\u200b\u200b&nbsp;<\/p>\n\n\n\n<p><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p>Deutsch<\/p>\n\n\n\n<p class=\"has-large-font-size\"><strong>Verwaltungsgericht Wien erkl\u00e4rt R\u00e4umung des Solidarit\u00e4tscamps f\u00fcr Pal\u00e4stina Wien f\u00fcr verfassungswidrig<\/strong>&nbsp;&nbsp;<\/p>\n\n\n\n<p>Im November 2024 entschied das Verwaltungsgericht Wien \u00fcber eine Beschwerde gegen die Wiener Polizei bez\u00fcglich der R\u00e4umung des Solidarit\u00e4tscamps f\u00fcr Pal\u00e4stina in Wien am 8. Mai 2024 und erkl\u00e4rte die von der Polizei ergriffenen Ma\u00dfnahmen f\u00fcr rechtswidrig, sowie verfassungswidrig.\u202f&nbsp;<\/p>\n\n\n\n<p>Das Solidarit\u00e4tscamp f\u00fcr Pal\u00e4stina war erst drei Tage zuvor auf dem Campus der Universit\u00e4t Wien errichtet worden, als die <em>Wiener Einsatzgruppe Alarmabteilung (WEGA)<\/em> der Wiener Polizei es mitten in der Nacht st\u00fcrmte und die anwesenden Studierenden angriff. Rund 200 bewaffnete Polizeibeamte vertrieben die Studierenden und Aktivist:innen gewaltsam mit Drohnen, Observationsfahrzeugen, Polizeihunden, Lastw\u00e4gen und einem Kran. \u202f&nbsp;<\/p>\n\n\n\n<p>Zum Zeitpunkt der Razzia gab die Polizei keine klare Angabe oder einheitliche Rechtsgrundlage daf\u00fcr, warum das Camp ger\u00e4umt wurde. Die Wiener Polizeidirektion erkl\u00e4rte sp\u00e4ter, dass nach \u201eeiner abschlie\u00dfenden Bewertung durch die Direktion f\u00fcr Staatssicherheit und Nachrichtendienst (DSN) [&#8230;] der Zweck dieser Versammlung nach eingehender Pr\u00fcfung nicht mehr mit der \u00f6sterreichischen Rechtslage vereinbar war\u201d. Laut der Polizeidirektion Wien \u201emusste die Staatsanwaltschaft zu dem Schluss kommen, dass das wahre Ziel oder der wahre Zweck der Versammlung [&#8230;] darin bestand, Solidarit\u00e4t mit den Zielen von HAMAS zu zeigen und einen geistigen N\u00e4hrboden f\u00fcr die Billigung terroristischer Straftaten im Sinne von \u00a7 282a Abs. 2 StGB (Billigung terroristischer Straftaten) zu schaffen.\u201d&nbsp;&nbsp;<\/p>\n\n\n\n<p>Die Polizei begr\u00fcndete diese Behauptungen damit, dass Versammlungsteilnehmer:innen den Slogan \u201eFrom the River to the Sea, Palestine will be free\u201c gerufen h\u00e4tten und dass das Wort \u201eIntifada\u201c auf Bannern zu sehen gewesen sei.&nbsp;&nbsp;<\/p>\n\n\n\n<p><strong>Keinerlei sachliche&nbsp; Begr\u00fcndung<\/strong>&nbsp;<\/p>\n\n\n\n<p>Das Gericht wies diese Behauptungen mit der Begr\u00fcndung zur\u00fcck, dass die Versammlungs- und Meinungsfreiheit auch dann gesch\u00fctzt sind, wenn die ge\u00e4u\u00dferten Meinungen schockierend oder beleidigend sind. Dies ist in der st\u00e4ndigen Rechtsprechung des Europ\u00e4ischen Gerichtshofs f\u00fcr Menschenrechte festgelegt. Dar\u00fcber hinaus w\u00fcrde das Bekunden von Sympathie f\u00fcr eine designierte terroristische Vereinigung, wie von der Wiener Polizei behauptet, nur dann eine Straftat nach \u00a7 282a StGB \u201eBilligung terroristischer Straftaten\u201c darstellen, wenn dadurch die Begehung tats\u00e4chlicher terroristischer Straftaten verursacht werden k\u00f6nnte. Dar\u00fcber hinaus erkannte das Gericht an, dass die blo\u00dfe Verwendung der Ausdr\u00fccke \u201eFrom The River To The Sea, Palestine Will Be Free\u201c und \u201eIntifada\u201c keine Anstiftung zur Begehung einer terroristischen Straftat darstellt und nicht a priori eine eindeutige Identifikation mit der Hamas bedeutet, es sei denn, weitere Ausdr\u00fccke deuten auf das Gegenteil hin. Daher kann nicht <em>von vornherein <\/em>geschlussfolgert werden, dass diese Slogans einen \u201egeistigen N\u00e4hrboden f\u00fcr die Billigung terroristischer Verbrechen\u201c schaffen w\u00fcrden. Somit besteht keinerlei Sachlage, die die Aufl\u00f6sung der Versammlung rechtfertigen w\u00fcrde.\u202f&nbsp;<\/p>\n\n\n\n<p><strong>Der rechtswidrige \u00dcberfall auf das Camp<\/strong>&nbsp;&nbsp;<\/p>\n\n\n\n<p>W\u00e4hrend der R\u00e4umung weigerten sich vier Studierende das Camp zu verlassen, nachdem die Polizei es gest\u00fcrmt hatte. So wollten sie die R\u00e4umung verhindern und das Camp sch\u00fctzen. Drei der Studierenden wurden daraufhin gewaltsam aus dem Camp geschafft, isoliert und in Gewahrsam genommen. Eine weitere studierende Person widersetzte sich der R\u00e4umung und einer m\u00f6glichen Verhaftung, indem sie auf einen nahen gelegenen Baum kletterte und dort etwa acht Stunden lang ausharrte. Stundenlang wurde ihnen Rechtsbeistand verweigert, und nur zwei Personen durften das Areal f\u00fcr lediglich ein paar Minuten betreten, nachdem Demonstrant:innen lautstark f\u00fcr die Rechte der Studierenden eingetreten waren.&nbsp;&nbsp;<\/p>\n\n\n\n<p>W\u00e4hrenddessen versammelten sich spontan hunderteUnterst\u00fctzer:innen vor dem Campus, um ihre Solidarit\u00e4t zu bekunden, und blockierten Stra\u00dfenbahnen und den Verkehr an der Kreuzung Alser Stra\u00dfe und Spitalgasse im 9. Wiener Bezirk. Es wurde berichtet, dass die Polizei rassistische Bemerkungen gegen\u00fcber den Protestierenden machte und einer Person sagte, sie solle \u201edorthin zur\u00fcckgehen, wo sie hergekommen ist\u201d, nachdem eine englische \u00dcbersetzung der Anweisungen der Polizei erbeten wurde.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Die Studierenden und Unterst\u00fctzer:innen vor dem Campus protestierten bis in die Morgenstunden des 9. Mai, besetzten die Stra\u00dfenbahnlinien und verhinderten damit <em>business as usual<\/em>. Am fr\u00fchen Morgen setzten sie ihren Protest bis zum Polizeianhaltezentrum (PAZ) in der Ro\u00dfauer L\u00e4nde fort, wo sie die Freilassung der verhafteten Aktivist:innen forderten und gegen die Zerst\u00f6rung des Camps protestierten. Sie wurden dabei von einer Kolonne von Polizeifahrzeugen begleitet. Als sie im PAZ ankamen, wurden sie von einer Reihe von sieben Polizeifahrzeugen empfangen. Innerhalb weniger Minuten nach ihrer Ankunft wurden etwa 30 Personen von der Polizei aggressiv umzingelt und durften das Gel\u00e4nde nicht verlassen. Polizeibeamte griffen Demonstrierende k\u00f6rperlich an und drohten zur Einsch\u00fcchterung mit Verhaftungen. Die Polizei zwang schlie\u00dflich alle Demonstrierenden, sich auszuweisen. Mehrere Demonstrierende wurden gezwungen, sich fotografieren zu lassen. Diese erhielten sp\u00e4ter von der Polizei die Auskunft, dass strafrechtliche Ermittlungen gegen sie eingeleitet werden.\u202f&nbsp;<\/p>\n\n\n\n<p>Einige der Studierenden sahen es als unumg\u00e4nglich an, dem nicht tatenlos zuzusehen. Sie brachten diesen Fall vor Gericht, um auf die Repression gegen die Pal\u00e4stina-Solidarit\u00e4tsbewegung in \u00d6sterreich aufmerksam zu machen.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Kiran Chaudhuri, Senior Legal Officer des ELSC, erkl\u00e4rte: \u201eWir begr\u00fc\u00dfen dieses Urteil, das von unseren Partneranw\u00e4lt:innen in \u00d6sterreich erstritten wurde, als einen juristischen Erfolg gegen die zunehmend autorit\u00e4re anti-pal\u00e4stinensische Repression durch europ\u00e4ische Polizeibeh\u00f6rden. Das Gericht hat unmissverst\u00e4ndlich klargestellt, dass die Meinungs- und Versammlungsfreiheit verfassungsm\u00e4\u00dfige Rechte sind, die nicht von der Polizei gew\u00e4hrt werden, sondern vielmehr von den Beh\u00f6rden gesch\u00fctzt werden m\u00fcssen. Das Urteil kann als Pr\u00e4zedenzfall f\u00fcr \u00e4hnliche rechtswidrige Polizeieins\u00e4tze gegen die wachsende pal\u00e4stinensische Solidarit\u00e4tsbewegung in Europa
