{"id":2047,"date":"2022-06-13T19:38:09","date_gmt":"2022-06-13T17:38:09","guid":{"rendered":"https:\/\/cms.elsc.support\/?p=2047"},"modified":"2025-04-11T21:04:52","modified_gmt":"2025-04-11T19:04:52","slug":"elsc","status":"publish","type":"post","link":"https:\/\/elsc.support\/ar\/elsc\/","title":{"rendered":"ELSC Newsletter: May 2022"},"content":{"rendered":"<p>This month, we achieved <strong>an important victory as a German court ruled in favour of scholar Dr. Anna Younes in digital surveillance case.<\/strong><\/p>\n\n\n\n<div class=\"wp-block-buttons is-layout-flex wp-block-buttons-is-layout-flex\">\n<div class=\"wp-block-button aligncenter\"><a class=\"wp-block-button__link\" href=\"https:\/\/elsc.support\/ar\/newsletter\/\" target=\"_blank\" rel=\"noreferrer noopener\">subscribe to our newsletter<\/a><\/div>\n<\/div>\n\n\n\n<p><br>On 6 May 2022, the Berlin District Court upheld Dr. Younes\u2019 claims and ordered VDK \u2013 the German state-funded organisation that legally represents RIAS Berlin and MBR \u2013 to give Anna Younes access to data that the two civil society organisations had gathered on her and passed on to others. The information released so far reveals that RIAS and MBR have been c<strong>ollecting people\u2019s personal data based on their \u201cpositions on Israel and BDS\u201d<\/strong>.<\/p>\n\n\n\n<h3 class=\"has-text-align-center wp-block-heading\"><strong><a href=\"https:\/\/support.us20.list-manage.com\/track\/click?u=0de9e0231539d1a4c5b3272e5&amp;id=ef8256de42&amp;e=fc68334d0d\" target=\"_blank\" rel=\"noreferrer noopener\">Read more<\/a><\/strong><\/h3>\n\n\n\n<p><strong>What\u2019s next?<\/strong><br><br>Dr. Younes and her lawyer will request damages in court as RIAS\/MBR prevented her from accessing her information for two years. It also remains to be clarified whether RIAS and MBR have been storing further data other than those revealed in the disseminated dossier.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p><em>This is an important victory because organisations using the IHRA definition for the surveillance of Palestinian rights advocates will be required to provide access to the information they collect on individuals. We believe that this is not an isolated case and that there is a structural issue of profiling Palestinians and Palestinian rights advocates in Germany. This is what we intend to challenge further in court. After a smear campaign against the Palestinian researcher, those institutions decided to <a href=\"https:\/\/web.archive.org\/web\/20220530133255\/https:\/www.akbild.ac.at\/en\/institutes\/art-theory-and-cultural-studies\/events\/conferences\/2022\/the-spring-curatorial-program\/statement-on-the-discussion-about-the-lecture-2.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">cancel <\/a>her presence only few days before the panel. Her censorship was justified by false allegations that depicted her as an \u201cantisemitic\u201d. The label was used with the effect of silencing the only Palestinian voice in a program dedicated to post-colonial research.<\/p>\n\n\n\n<p>The ELSC reached out to its support network, the contributors and organisers of the event. The contributors set up a <a href=\"https:\/\/support.us20.list-manage.com\/track\/click?u=0de9e0231539d1a4c5b3272e5&amp;id=3c733e83a3&amp;e=fc68334d0d\" target=\"_blank\" rel=\"noopener\">letter of support<\/a> signed by more than 300 scholars, artists and students. They based their decision on unfounded allegations, using a language that amount to Anti-Palestinian racism. After those smears were picked up by national newspapers, the organisers have also been accused by the Central Council of Jews in Germany of not properly dealing with antisemitism. Olivia Z\u00e9mor, the President of BDS group&nbsp;<em>CAPJPO-EuroPalestine<\/em>, was accused of incitement to discrimination and public defamation by pharmaceutical company Teva Sant\u00e9 because she amplified calls to boycott the company on <em>EuroPalestine\u2019<\/em>s website.<br><br>Just like in the first instance, the Court of Appeal rejected both accusations and reiterated the legitimacy of the BDS (Boycott-Divestment-Sanctions) call and its protection as a form of expression, referring to the <a href=\"https:\/\/support.us20.list-manage.com\/track\/click?u=0de9e0231539d1a4c5b3272e5&amp;id=636b272d79&amp;e=fc68334d0d\" target=\"_blank\" rel=\"noopener\"><em>Baldassi<\/em> case<\/a> in its reasoning.<\/p>\n\n\n\n<h3 class=\"has-text-align-center wp-block-heading\"><a href=\"https:\/\/support.us20.list-manage.com\/track\/click?u=0de9e0231539d1a4c5b3272e5&amp;id=a4037b6e87&amp;e=fc68334d0d\" target=\"_blank\" rel=\"noreferrer noopener\">Read more<\/a><\/h3>\n\n\n\n<p>In two <a href=\"https:\/\/support.us20.list-manage.com\/track\/click?u=0de9e0231539d1a4c5b3272e5&amp;id=19018b74e5&amp;e=fc68334d0d\" target=\"_blank\" rel=\"noopener\"><strong>landmark rulings<\/strong><\/a> dated 29 April 2022, the French highest administrative court <strong>prevented the dissolution <\/strong>of the Comit\u00e9 Action Palestine (CAP) and the Collectif Palestine Vaincra (CPV).<br>&nbsp;<br>French government had signed two governmental decrees on 9 March 2022, pronouncing the dissolution of the two Palestine solidarity groups, based on both groups\u2019 alleged incitement to hatred, discrimination, or violence, as well as their supposed provocation to commit terrorist offences.<\/p>\n\n\n\n<p>The Council of State rejected the unfounded allegations of antisemitism and support to terrorism made against the groups and determined that the decrees gravely violated the groups\u2019 fundamental freedoms of association and of expression.
