This effectively ends the Schengen-area travel ban imposed on Prof. Dr. Abu Sittah by German authorities. He was previously prevented from entering Germany, France and most recently the Netherlands.&nbsp;<\/p>\n\n\n\n<p>The court\u2019s ruling follows ELSC lawyer Alexander Gorski\u2019s arguments in all points and recognizes the urgency of the case vis-a-vis developments in Gaza. The court rejects all accusations by German Federal Police against Dr Abu Sittah and holds that the Federal Police provided no grounds according to the legal basis provided by Art. 24 EU-Verordnung 2018\/1861 and \u00a7 30 Abs. 5 BundespolizeiG.&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-center\">&#8220;<strong>This victory cannot be overstated<\/strong>&#8220;<\/p>\n\n\n\n<p>Alexander Gorski shares: \u201cGerman police delivered a surprisingly weak reasoning for the entry ban issued against Dr Ghassan Abu Sitta in front of the court. By rejecting it as lacking any substantial evidence, the court affirms our case and calls the entire investigation into question. Professor Ghassan worked tirelessly to help Palestinians in Gaza, in dreadful conditions, and yet he has faced such unfair treatment upon his return. &nbsp;<br>&nbsp;<br>This decision means that Ghassan\u2019s freedom of expression and freedom of movement are no longer under threat, and he can speak out about what he witnessed in Gaza. This victory cannot be overstated.\u201d&nbsp;<\/p>\n\n\n\n<p>This victory highlights the illegality of Germany\u2019s increasingly authoritarian anti-Palestinian state repression and should encourage everyone to speak up against the ongoing genocide on Gaza. We thank Prof. Dr. Ghassan Abu Sittah for his courage in speaking up against the crimes he has witnessed first handedly and against the shameful attempt by the German state to silence critics of the genocide <a href=\"https:\/\/elsc.support\/ar\/news\/legal-action-to-stop-arms-exports-from-germany-to-israel\/\" target=\"_blank\" rel=\"noreferrer noopener\">it is funding<\/a>. Mai 2024&nbsp;&nbsp;<\/p>\n\n\n\n<p>Berlin, Verwaltungsgericht Potsdam r\u00fcgt deutsche Bundespolizei: Die Schengen-Einreise f\u00fcr Prof. Dr. Ghassan Abu Sittah entbehrt jeder rechtlichen Grundlage und ist sofort zu widerrufen. Das Urteil folgt auf einen Eilantrag des ELSC Anwalts Alexander Gorski mit Unterst\u00fctzung von Anw\u00e4lten des International Centre of Justice for Palestinians (ICJP). Damit ist das von den deutschen Beh\u00f6rden gegen Prof. Dr. Abu Sittah verh\u00e4ngte EU-Einreiseverbot nichtig. Zuvor war er an der Einreise nach Deutschland, Frankreich und zuletzt in die Niederlande gehindert worden. &nbsp;<\/p>\n\n\n\n<p>Das Gericht folgt den Argumenten des ELSC-Anwalts Alexander Gorski in allen Punkten und erkennt die Dringlichkeit des Falles angesichts der Entwicklungen in Gaza an. Das Gericht weist alle Vorw\u00fcrfe der deutschen Bundespolizei gegen Prof. Dr. Abu Sittah zur\u00fcck und stellt fest, dass die Bundespolizei keinerlei Begr\u00fcndung gem\u00e4\u00df der Rechtsgrundlage des Art. 24 EU-Verordnung 2018\/1861 und \u00a7 30 Abs. 5 BundespolizeiG vorweisen kann.&nbsp;<\/p>\n\n\n\n<p class=\"has-text-align-center\">&#8220;<strong>Dieser Erfolg kann nicht hoch genug gesch\u00e4tzt werden<\/strong>&#8220;<\/p>\n\n\n\n<p>Alexander Gorski kommentiert: \u201eDie Bundespolizei hat vor Gericht eine \u00fcberraschend schwache Begr\u00fcndung f\u00fcr das gegen Prof. Dr. Ghassan Abu Sitta erlassene Einreiseverbot geliefert. Indem das Gericht sie als nicht stichhaltig zur\u00fcckweist, bekr\u00e4ftigt es unser Anliegen und stellt die gesamten polizeilichen Ermittlungen in Frage. Professor Ghassan hat Pal\u00e4stinenser*innen in Gaza unter schrecklichsten Bedingungen unerm\u00fcdlich geholfen, und dennoch wurde er nach seiner R\u00fcckkehr so ungerecht behandelt. &nbsp;&nbsp;<\/p>\n\n\n\n<p>Diese Entscheidung bedeutet, dass Prof. Abu Sittah Recht auf freie Meinungs\u00e4u\u00dferung und Freiz\u00fcgigkeit nicht mehr bedroht ist. Er kann wieder frei dar\u00fcber sprechen, was er in Gaza erlebt hat. Dieser Erfolgkann nicht hoch genug gesch\u00e4tzt werden.\u201c &nbsp;<\/p>\n\n\n\n<p>Dieser Erfolgverdeutlicht die Rechtswidrigkeit der zunehmend autorit\u00e4ren anti-pal\u00e4stinensischen Repression durch den deutschen Staat und sollte jeden ermutigen, seine Stimme gegen den anhaltenden V\u00f6lkermord in Gaza zu erheben. Wir danken Prof. Dr. Ghassan Abu Sittah f\u00fcr seinen Mut, sich gegen die Verbrechen auszusprechen, die er mit eigenen Augen miterlebt hat. Ebenso \u00e4chten wir den besch\u00e4menden Versuch des deutschen Staates, Kritiker*innen des <a href=\"https:\/\/elsc.support\/ar\/news\/legal-action-to-stop-arms-exports-from-germany-to-israel\/\" target=\"_blank\" rel=\"noreferrer noopener\">von ihm finanzierten V\u00f6lkermords<\/a> zum Schweigen zu bringen. &nbsp;Abu Sittah wird am 17.
